It was not clear to her whether the provisions of international instruments ratified by Gabon took precedence over constitutional provisions.

Thus, the Constitution establishes the precedence of provisions of international treaties over national law.

quot (9) Priority with regard to the receivables includes priority with regard to cash received upon collection or other disposition of the receivables, provided that the cash may be identified as proceeds of the receivables. quot

Initially, the Commission had only intended, through that article, to give precedence to special treaty provisions, such as those contained in investment protection treaties, over the draft articles.

Part A includes revised draft articles for a convention on arrest of ships, and part B contains draft final clauses prepared by the secretariats on the basis of the final provisions of the 1993 International Convention on Maritime Liens and Mortgages (1993 MLM Convention).

It would hardly be correct in that case to give priority to non international treaties, as was done in draft article 3, paragraph 3.

In summary, the proposal clearly set out maritime liens recognized under Article 4 of the MLM Convention and provided a means of enforcing maritime liens other than those recognized in Article 4 of the Convention, but no State was required to enforce maritime liens arising under Article 3 (1) (b).

Rule 18

As to the above mentioned matter, the Draft Law tends to prioritize international treaties (of which Viet Nam is a party) over domestic law (Paragraph 2 of Article 4).

Typically, earmarked contributions are subject to criteria that are determined a priori, reducing the ability of recipients to reallocate the resources to evolving international or national priorities.

4. If a receivable is assigned pursuant to a contract of assignment concluded before the date when the denunciation takes effect in respect of the Contracting State referred to in article 1, paragraph 1 (a), the right of the assignee has priority over the right of a competing claimant with respect to the receivable to the extent that, under the law that would determine priority under this Convention, the right of the assignee would have priority.

They do permit borrowers to apply domestic price preferences and, for several of the regional institutions, regional price preferences.

(5) Notwithstanding the preceding paragraphs of this article, conflicts of priority may be settled by agreement between competing assignees.

The representative of Cuba, on a point of procedure, suggested that all the articles should be reviewed as a whole and that, eventually, articles 1 and 8 could be given priority.

Contractual arrangements entered into between the parties should take precedence over rules coming from other sources, and in that connection it was important to ensure the enforceability of those terms and conditions.
