This is a disarmament convention and should remain as such as the objective of the Convention so stipulates.

This State will apply the Convention only to those arbitral awards which were adopted after the entry into effect of the Convention.

In practice, therefore, only CISG and the Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 (New York Convention) would be affected.

The United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention) requires arbitration agreements to be in writing.

Certain State courts have adopted the view that the New York Convention is a self contained regime and ruled that it would be contrary to the intentions of the authors of the New York Convention if awards made on the basis of an agreement that did not comply with the New York Convention's requirements would nevertheless benefit from its regime.

One view was that the principle of freedom of arbitration was deeply rooted and that existing arbitration instruments such as the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, 1958 (the New York Convention) and the UNCITRAL Model Law on International Commercial Arbitration provided an adequate framework for arbitration, thus obviating the need for such a chapter in the draft convention.

For decades, important treaties and conventions, such as the NPT, the Chemical Weapons Convention, the Biological and Toxin Weapons Convention and the Convention on Certain Conventional Weapons have constituted the international legal framework of multilateral arms control, disarmament and non proliferation.

UNCITRAL continued to monitor the legislative implementation of the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the New York Convention).

One of the topics raised for consideration was the extent to which modernization of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 1958) (hereafter referred to as the New York Convention ) was needed in respect of the formation of the arbitration agreement.

The arbitral tribunal shall render its decisions in accordance with the provisions of the Convention and international law.

A country which is a party to every treaty and every convention in the area of disarmament.

It has achieved many successes in negotiating and finalizing important disarmament treaties and conventions.

This is recognized in several disarmament and arms control agreements, treaties and conventions.

m The Convention only applies with regard to Malta with respect to arbitration agreements concluded after the date of Malta's accession to the Convention.

The State party should apply article 12 of the Covenant to all its nationals.

2. The Geneva Protocol on Arbitration Clauses of 1923 and the Geneva Convention on the Execution of Foreign Arbitral Awards of 1927 shall cease to have effect between Contracting States on their becoming bound and to the extent that they become bound, by this Convention.

The participants at the conference unanimously called for the strengthening of existing disarmament related treaties and conventions.

The arbitral tribunal applied the CISG as the relevant German law under article 1(1)(b) CISG.

25. As for the monitoring of the implementation of the Convention on the Recognition and Enforcement of Foreign Arbitrage Awards (New York, 1958), he said that Belarus had prepared a draft law on arbitration.

The subsidiary of a parent company was bound by a sales contract that contained an arbitration clause.

The Committee welcomes the assurance that the Covenant may be directly invoked before domestic courts in MSAR, and that there have been specific decisions of domestic courts in which reference has been made to the Covenant and its provisions.

We do not believe that a discussion in the CD about a timetable for the final achievement of nuclear disarmament would be a productive use of the CD apos s time or make best use of the CD apos s proven talents in negotiating specific treaties on discrete topics.

Switzerland impatiently awaits the implementation of this Convention, which is the fruit of long years of negotiations in our institution.

257. During its thirty first session, on 10 June 1998, the Commission held a special commemorative New York Convention Day in order to celebrate the fortieth anniversary of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 10 June 1958).

The Court also found that the YCJA was not inconsistent with the Convention on the Rights of the Child or the International Covenant on Civil and Political Rights.

At its thirty first session (New York, 1 12 June 1998), the Commission, with reference to discussions at the special commemorative New York Convention Day held in June 1998 to celebrate the fortieth anniversary of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 1958) ( the New York Convention ), considered that it would be useful to engage in a discussion of possible future work in the area of arbitration.

Draft paragraphs 4 and 5, which were interrelated, had been added relatively late in the proceedings as a consequence of the decision by the Working Group to include the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 1958) ( the New York Convention ), on the advice of Working Group II (Arbitration), in the list of conventions in draft article 19, paragraph 1.

Stressing that the purpose of the project was not to monitor individual court decisions applying the Convention, the Commission called upon the States parties to the Convention to send to the Secretariat the laws dealing with the recognition and enforcement of foreign arbitral awards.

In this connection, Tunisia has ratified ILO Conventions No. 6, the Night Work of Young Persons (Industry) Convention, 1919 No. 77, the Medical Examination of Young Persons (Industry) Convention, 1946 and No. 124, the Medical Examination of Young Persons (Underground Work) Convention, 1965.
