A majority of the members of the Committee shall constitute a quorum.

The adoption of decisions by the Committee shall require a quorum of at least three fourths of the members to be present.

A majority of the members of the Committee shall constitute a quorum. The presence of two thirds of the members of the Committee is, however, required for a decision to be taken.

The Commission will be free to elect as many officers as it deems advisable.

The Chairman of any subsidiary body of limited membership may do so when representatives of a majority of its members are present. The presence of representatives of a majority of the States so participating shall be required for any decision to be taken.

This resulted in a total of 37 against the 36 members prescribed in the Convention.

If in the second ballot the votes are equally divided, and a majority is required, the Chairperson shall decide between the candidates by drawing lots.

A record attendance of 887 persons had attended.

Quorum

Forty eight Assembly seats are allocated as compensatory seats for minority groups that are unable to meet the electoral quota.

A total of 427 participants were accredited (see annex I), although the number of actual participants attending the session was larger.

If the Chairperson is unable to represent the Committee at such a meeting, she or he may designate another officer of the Committee or, if no officer is available, another member of the Committee, to attend on her or his behalf.

At those meetings, for which two thirds of the States parties shall constitute a quorum, the persons elected to the Sub Committee shall be those who obtain the largest number of votes and an absolute majority of the votes of the representatives of the States parties present and voting.

It is the superior court of record and consists of the Chief Justice, the Deputy Chief Justice and Supreme Court judges whose number is prescribed by the Supreme Court Act and are appointed by the President.

That creates procedural difficulties for the Assembly of the Authority and impedes its efficient operation, since the quorum required under the Convention is a presence of one half of the members.

The presence of representatives of a majority of the States so participating shall be required for any decision to be taken.

18. Half of the members of UNCITRAL would complete their mandates in 1997, and new elections would be held it was already clear that there would be more candidates than slots, a sign of the importance which States attached to the Commission s work.

Quorum

At least two thirds of the members of the Executive Board, representing a majority of members from Parties included in Annex I and a majority of members from Parties not included in Annex I, must be present to constitute a quorum.

It may be noted that the representation continued to be markedly better as regards the number of representatives listed, and even more so in terms of actual presence in the meeting room and active participation.

66. The majority of the accused (12 out of 15) were tried in absentia, as Yugoslav law permits.

Since five candidates had received the required absolute majority of votes in the Security Council, the President of the Council communicated the results of the voting in writing to the President of the General Assembly.

Intended Presence

If required, the matter shall be put to the vote and decided by majority vote of the members of the Bureau present and voting.

The President of the latter should not communicate such names to the members of that organ until that organ has itself given five candidates the required majority of votes.

The quorum for any meeting of the Council shall be the presence of a majority of members of each category referred to in article 4, provided that such members hold at least two thirds of the total votes in their respective categories.

Article 4, paragraph 4, of the Statute further stipulates that the persons elected to the Tribunal shall be those nominees who obtain the largest number of votes and a two thirds majority of the States Parties present and voting, provided that such majority includes a majority of the States Parties.

On a proposal by the Chairman, it was recommended that rule 51.2 of the provisional rules of procedure, which deals with the quorum for any committee or subcommittee of the International Meeting, be suspended in order to allow the Credentials Committee to meet with only four members present, the quorum for that Committee of nine members normally being five.

The Circuit Court dismissed the author's appeal of this decision and concluded that he had been duly summoned to the hearing even if he was unable to attend and that the court had had ample opportunity to formulate an informed opinion on the petition in his absence.

It is the latter, whose numbers are sometimes down to 10, who are the only members taking their seats in the National Assembly.
