33. ADs, CVs and even quotas are fairly transparent forms of NTB.

However, they should avoid replacing tariffs and non tariff barriers with administered protection measures, such as anti dumping restrictions.

The developed countries should avoid resorting to anti dumping and countervailing duties to unfairly target developing country exports.

Concern was also expressed that textile quotas may be replaced by anti dumping measures and other NTB measures.

Some countries have applied special rules of origin for the implementation of anti circumvention measures which aimed to prevent alleged evasions of anti dumping duties the result is the extension of anti dumping duties to third countries without separate investigations of dumping and injury.

In 1995 1996, 147 anti dumping actions were initiated by a number of developed countries and nearly 600 definitive anti dumping duties were in force in these countries at the end of 1996.

Conversely, the presence of quotas or countervailing duties affecting the potential host country is discouraging for investors.

Europe Should Dump Anti Dumping

The abusive use of anti dumping measures was a matter of concern to his delegation.

In cases of necessity, the customs may request the taxpayers to make up for the declaration.

Nor has any breakthrough been reached in the area of trade, in spite of the recognition by the Conference of issues of particular interest to developing countries subsidies, anti dumping measures, trade liberalization for agricultural products, tariff peaks and tariff escalation and special and differential treatment, to name just a few.

Simply put, anti dumping measures, such as the US and EU tariffs against Chinese solar panels, are a means of reducing, not fostering, competition. So, if predatory pricing is not the producers motive for selling below cost in these cases, what is?

Those immediate steps should include an agreement on an end date for eliminating agriculture export subsidies, a commitment to eliminate tariff peaks and tariff escalations, a moratorium on anti dumping actions against poor countries, an end to the abusive use of standards for protection and the initiation of a development review of intellectual property.

8. Reaffirms the importance of market access, and in this context recalls the importance of respect for World Trade Organization disciplines, including in the area of anti dumping, inter alia, to avoid the abusive application of anti dumping and other trade distorting measures

Experts agreed that developing countries engaged in steel trade, for example Brazil, China, Egypt, India, Indonesia, Thailand, Malaysia and Viet Nam, faced market distortions due both to market access barriers and to trade measures, including subsidies, anti dumping actions, and tariff peaks and tariff escalation.

Some are directly trade related (e.g. import quotas, import surcharges, anti dumping measures), others have a link to trade in as far as their implementation is monitored at the border (e.g. labelling, packaging, sanitary standards), while a third group arises from general public policy (e.g. government procurement, investment restrictions, extent of intellectual property right protection).

The measures initially adopted can be administrative fixing of prices and voluntary restriction of the minimum price level of exports or investigation of prices to subsequently arrive at one of the following adjustment mechanisms suspension of import licences, application of variable charges, antidumping measures or countervailing duties.

Last fall, the US introduced tariffs of 24 36 against Chinese solar panel imports, after the Commerce Department determined that China had been dumping which is generally defined as selling at a price below cost into the American market. China, citing its own finding of US dumping of polysilicon a key input in the production of solar panels into its market, has already retaliated by imposing import tariffs that could exceed 50 .

The rules negotiations cover anti dumping, subsidies and countervailing measures, including fisheries subsidies, and regional trade agreements.

(d) Abusive application of anti dumping, sanitary and phytosanitary standards and other trade distorting measures
