In practically every case, the payment for the performance of a public contract in those countries was made in the form of a price paid by the governmental agency to the supplier or contractor.

Additional significant contractual commitments and disbursements are expected in the upcoming period.

II. Payments to the United Nations

The general terms of delivery and payment of the contract contained a choice of German law and special rules on the notice of lack of conformity.

The Board also looked into the provisions of the contracts and the timeliness of delivery of the expected outputs.

17. The level of unpaid peacekeeping obligations to Member States who provide troops and equipment for United Nations missions is the principal obligation of the Organization and that obligation is now in a state of very protracted delay.

44. Concerning advance payments on contracts at the United Nations Office at Nairobi, the Board recommended, in paragraph 89 of its report, that the Administration ensure that the reasons for advance payment be recorded.

The court also found that the Italian company was not obliged to make any payment for breach of contract.
