Of the 19 claims, 18 were deferred for determinations in respect of stand alone, overlapping and competing business claim issues and for investigation of potential irregularities in the documentation provided by claimants in support of their asserted business losses.

The individual claimant whose claim had been identified as potentially overlapping with the E4 claim provided additional evidence and claimed for losses in addition to those losses claimed by the E4 claimant.

There are also three claimants in this instalment whose individual claims for C8 Business losses were determined to be claims for corporate losses.

The monitoring and assessment claims of Iran that were awarded funding in the first F4 instalment and are relevant to claim No. 5000287 are claim Nos. 5000392, 5000393 and 5000395.

Specifically, the secretariat, in valuing the claimant's D6 (loss of income) claim, incorrectly treated it as a duplicate of the claimant's C6 (salary loss) claim, resulting in an erroneous reduction of the amount of compensation awarded to the claimant for his C6 claim.

Of these, the total amount awarded for 334 claims was increased by USD 2,523,268.24 and the total amount awarded for three claims was decreased by USD 42,543.06.

Category C corrections Recommendations for corrections to category C claims are those arising from confirmed duplicate claims, discrepancies between the electronic and paper claim formats, and multiple recovery based on the duplication of claim awards.

The monitoring and assessment claims of Iran that were awarded funding in the first F4 instalment and are relevant to claim No. 5000301 are claim Nos. 5000329, 5000330, 5000346, 5000347, 5000348, 5000349, 5000350, 5000351 and 5000382.

Overall, there are 31,31,70 claims that the Panel has determined to be ineligible for inclusion in the late claims programme because the claimants failed to provide satisfactory reasons for late filing.

This aspect of the original F3 claim was remitted to the Registrar of the Commission, allocated a new claim number, and set aside for future review (the current F3' claim ).

Of these, the total amount awarded for one claim was increased by USD 682,000 and the total amount awarded for the other claim was decreased by USD 3,234,000.

The searches identified 104 E4 claims with approved awards of compensation in the first seven instalments as potentially overlapping with 61 claims in category C and 70 claims in category D .

The Panel reviewed the overlapping claims together to determine which of the losses claimed by the category C claimant should be consolidated with the E4 claim for review.

During the course of its review of claims in the special instalment, the Panel identified one claim that included D8 D9 (individual business) losses in respect of two ready made clothing businesses that were also the subject of a category D claim filed by an Indian claimant in the regular claims programme, which was awarded compensation.

The individual claimant whose claim had been identified as potentially overlapping with the E4 claim has provided evidence in the form of audited financial statements and invoices to support the claim for loss of stock and loss of profits.

Of these, the total amount awarded for two claims was increased by USD 8,000, while the total amount awarded for 54 claims was decreased by USD 114,000.

The Panel finds that 4,24 of these claims, with a total amount claimed of USD ,6,866,203.4, are eligible for inclusion in the late claims programme.

VI. QUANTIFICATION OF THE CLAIMS

The monitoring and assessment claim of Jordan that was awarded funding in the first F4 instalment and is relevant to claim No. 5000464 is claim No. 5000353.

Of these, the total amount awarded for six claims was increased by USD 188,948.76 and the total amount awarded to two claims was decreased by USD 123,750.87.

Observing that in the course of claims processing, a number of category C , D and E competing claims were identified where two or more claimants claimed for the losses of the same business or company,

These studies were funded through awards for first F4 instalment claim Nos. 5000446 and 5000447.

These services were previously provided by contingent personnel.

The individual claimant whose claim had been identified as potentially overlapping with the E4 claim provided additional evidence (motor vehicle deregistration certificates) and claimed for losses in addition to those losses claimed by the E4 claimant.

In its First Report, the Panel determined that claimants who filed claims during the regular filing period in the same claim category had a full and effective opportunity to file claims with the Commission at that time.

The Panel found that the remainder of the potential claims, including all of the claims in respect of Bahraini detainees, did not meet the criteria for filing set out in decision 12 and, consequently, it did not accept these claims for filing.

For example, in the claim of Al Ghoson Contracting Company, the Panel became aware of irregularities in the audited accounts provided by the claimant to support its claim.

The Panel further determined that the existence of a previously filed claim in another claim category might, but does not necessarily, indicate that the claimant had a full and effective opportunity to file a claim during the regular filing period.

During the review of the stand alone claims in this instalment, one instance of a related category C claim was identified where a category D claimant had already received an award for the company's losses.

The Governing Council determined in decision 123 that a claim can only be found to be a stand alone claim if the claimant first demonstrates that he or she had the authority to act on behalf of the Kuwaiti company in filing a claim.

By signing the claim form, the claimant also authorizes Kuwait, through PAAC, to apply for and to receive the fixed amount of USD 2,500 on the claimant's behalf in the event that the Panel determines that the claimant is eligible to participate in the bedoun programme.

The Panel determined that irregularities in documents that relate to the claimant's reasons for participation in late filing, such as passports and other identification documents, result in the claimant's exclusion from the late claims programme.

All of the individual Palestinian claims in this instalment have been determined by the Palestinian Panel of Commissioners to be eligible for inclusion in the late claims programme, since those claimants have established that they did not have a full and effective opportunity to file claims with the Commission within its regular filing period for individual claims.

In the absence of a satisfactory response or the submission of the original document that relates to the claimant's reasons for late filing, the Panel finds that the claimant is not eligible to participate in the late claims programme.

With the completion of the irregularities review of claims, the Panel has determined that a total of 1,1,2 claims are not eligible for inclusion in the late claims programme due to irregularities.

(d) 458 claims filed by claimants identified as provisionally ineligible or of uncertain eligibility according to their data in the Executive Committee database

In this Decision the Governing Council determined that category C claims, together with claims in categories A and B , were considered to be urgent claims.

As a result of these matching procedures, the Panel determined that a total of 4,4,82 claims or nine per cent of the total claims population were not eligible for inclusion in the late claims programme.

The elements of Claim No. 5000309 were originally part of claim 5000208 in the F2 claims category.

Therefore, before undertaking any review of the claims in the fourthsecond group of overlapping claims, and as stated in the preamble to decision 123, the Panel directed the secretariat to solicit additional information from the claimants in order to identify the extent and nature of the overlapping claims ( claim development ).

The Panel found that this portion of the Claim did not meet the Commission s particularity requirement with respect to its statement of claim and therefore cannot recommend compensation for this portion of the Claim.
