The mission responded that the supplier of those products had emerged as the lowest bidder during prior biddings, that the price difference between this and the second lowest bidder was minimal in the past and that the supplier maintained the same profit margin above the government controlled prices.

(v) If the award is to be based on the lowest evaluated tender, the formula to be used to quantify the non price features to be presented.

(i) The tender with the lowest tender price, subject to any margin of preference applied pursuant to subparagraph (d) of this paragraph or

If its is intended that a bidder from a punctual Member State may be preferred over bidders from Member States in arrears (even if these offer better quality for better price), it would seem necessary to establish a range of price variation above the lowest acceptable bidder within which the decisive criterion would be the nationality of the bidder (for example, a higher bidder may be selected in no more than x above the lowest acceptable bidder).

An abnormally low tender is one that involves a risk that the tenderer would be unlikely to be able to perform the contract at the tender price or could do so using only substandard workmanship or materials by suffering a loss it could also indicate collusion between the tenderers (A CN.9 WG.V WP.22).

The most common procedure was the tendering method (adjudication), in which the contract was awarded to the tenderer offering the lowest price.

It was suggested that the term lowest evaluated tender in subparagraph n (bis) (v) should be replaced with the term most economically advantageous tender (as used in EU public procurement directive 2004 18 EC, article 53), as the former term might imply the offer with the lowest price .

Collusion can occur in the ERA when two or more bidders work in tandem to manipulate the price of an auction, or, alternatively, when a seller uses shells to enter fake bids and drive up the asking price.

From the perspective of the procuring entity, an abnormally low tender involves a risk that the contract cannot be performed, or performed at the price tendered, and additional costs and delays to the project may therefore ensue.

The Secretary General concluded that, in accordance with the financial rules, the awarding of contracts in the Secretariat is based on the lowest acceptable bid in order to ensure the best use of the Organization's resources, and that all valid bids, regardless of origin, are considered and evaluated for best offer without prejudice or preference.

They thus pose a significant threat of inflation, and the uncertainty about their future course is likely to discourage investment.

However, as it cannot generally be known who would have submitted the next best bid had the auction continued (since bidders may withdraw without submitting their best bid, if other bidders bid too low a price and it may not therefore be possible to identify the second best bidder), negotiations would be required with all other bidders.
