Article 1 of the new Act stipulates, there shall be established, within the courts of first instance and military courts, specialized chambers with exclusive competence to try the offences referred to in article 1 .

Two other cases are still pending before the Special Court.

2.2 On 10 February 1997, at the beginning of the court hearing, the author asked the trial judge to refer the case to another court, claiming that The Hague Regional Court could not be considered an independent and impartial tribunal.

In so doing, the Judges of the Trial Chambers have always endeavoured to ensure that judicial vacancies coincide with inter sessional periods, so as to avoid delays in trials.

As a consequence, the court postponed the hearing until 23 February 1996 and ordered the author's compulsory appearance at the hearing.

The Tribunal shall hold ordinary sessions at dates to be fixed by its rules, subject to there being cases on its list which, in the opinion of the President, justify holding the session. Extraordinary sessions may be convoked by the President when required by the cases on the list.

It then decided to take up the case again in a hearing scheduled for 16 December 1987.

The Court also decided that it lacked jurisdiction to entertain the complaint against the Province, based on the fact that, according to contractual terms, the ordinary courts of the Province were competent tribunals to hear the case.

The three Trial Chambers of the Tribunal have continued to function at maximum capacity, hearing six trials simultaneously and managing 18 cases in the pre trial stage.

2.12 On 11 March, the Trial Court dismissed the motion for reconsideration for lack of merit.

He argues that, owing to the special nature of the appeal process, the Chamber may not hear or review the entire proceedings of the court of first instance, but only analyse the grounds referred to by the applicant to decide whether or not they are in conformity with the law.

2.8 The case came before the judge again on 9 March 1992.

With nine ad litem judges, the Tribunal is able to set up six Trial Chamber Sections.

As a result of the decision of the Circuit Court, the case was remitted back to the first instance court. The author did not appear at this hearing, even though he was duly summoned.

(e) Judge Szénási, if appointed to serve in the International Tribunal for the trial of the Halilović case, proceed, once replaced as an ad litem judge of the International Tribunal, to finish that case, which he would have begun before expiry of his term of office

The Legal Aid Department provides legal representation to eligible persons in both civil and criminal cases heard in the Court of Final Appeal, the Court of Appeal, the Court of First Instance, the District Court and the Magistrates' Court (for committal proceedings).

Disputes shall be handled before the Labour Court, as a court of first and last instance, if they are brought by an employer s organization or an employees organization, or by the Ombudsman.

2.6 After the hearings on the admissibility of the evidence, the issues of custody, access and settlement of property were scheduled to be heard before another judge of the Family Court on 3 March 1992.

The Committee further notes the comments made by the State party concerning the nature of the remedy of judicial review, in particular that the court of second instance is limited to an examination as to whether the findings of the trial court amount to arbitrariness or denial of justice.
