Malta reported that its constitution granted an actio popularis to everyone who felt that a particular law infringed the constitution, and that some laws had to be amended after being challenged by the courts.

States parties are under an obligation to report fully upon legislation on non citizens and its implementation.

According to paragraph 313 of the report, any laws which are not in harmony with the Convention cannot be implemented.

(a) Continue to take all effective measures to bring domestic law and practice into line with the principles and provisions of the Convention

The Special Rapporteur is concerned that this law places citizens in an unequal position, and that members of minorities are suffering discrimination in its implementation.

The Law establishes the legal framework for these two areas, which will be developed according to regulations. (The Law will be published in Law of the Sea Bulletin No. 38.)

It is this Law that established that all citizens are covered under mandatory health care insurance, in accordance with the Law.
