(a) Three (5 per cent) of the claims had no supporting documentation 81 per cent of the 32 claims seeking compensation for loss of personal property did not submit independent documentary evidence, such as original receipts or invoices, in support of the claims

The Panel noted that several of the auditors had included pre invasion client lists in support of their claims.

The Board examined a random sample of 25 category B claims and found that, as in the case of category A claims, the quality of evidence supporting the claims was variable.

For example, in UNCC claim No. 3011313 the claimant supported his claim for business losses with audited financial statements for the fiscal year 1990 with an audit certificate dated 25 March 1991.

Noting also that the failure of these first in time competing claimants to return the overpayments has resulted in a situation where second in time competing claimants have ongoing competing claims related suspensions on payments,

C6 Support claims are for the loss of financial support to the claimant.

Noting also that at the time of filing, the secretariat and the claimants were not aware that the consolidation would have consequences regarding the payment of the claim and that had separate claims been filed rather than a consolidated claim, the claimants would have been paid in full by mid 2003,

Despite the poor quality of evidence submitted in support of the claims, the Commission concluded that the significantly reduced awards were reasonable.

The Panel notes that under the heading Support facilities the Claimant seeks compensation for costs incurred in removing unexploded ordnance during the period covered by the WBC Claim.

The Claimant explains that, potentially, the whole of the documentation that could be submitted in support of the WBC Claim is vast and could not feasibly be dealt with other than on a computerized basis.

The issues involved in that part included the required legal linkage between an individual and a State as a prerequisite of espousal of claim, i.e. the question of nationality, including multiple nationality, the problem of statelessness, espousal claims of non nationals, etc.

In relation to the family support payments component of the original F3 claim, the Panel considered what amount, if any, should be accounted for in the recommendations made by the Panel concerning the loss of support claims contained in the claims in the special instalment.

Iran, therefore, could have included these claim units in the submissions that it filed within these deadlines.

With regard to claims for expenses resulting from public health expenditures, Iraq contends that there is no legal basis for such claims.

Awards to be paid in respect of claims in the special instalment are net of any category A , B and C approved awards made to the same claimants.

At the time that the F3 Panel made its recommendations in respect of the original F3 claim, the claimed amount in respect of the family support payments aspect of the original F3 claim had risen to USD 69,680,679, plus a daily amount of USD 22,411 into the future.

The fourthsecond group of overlapping claims initially consisted of E4 claims related to 39seven category C claims and 24 category C and D claims.

These claims lack either the claimant's signature or evidence of authority to act on the part of the individual who filed the claim on behalf of the claimant.

While claims may be filed by a number of institutions against the peacekeeping missions, the final settlements are covered by obligations already reported as expenditures in the financial statements.

For example, in UNCC claim No. 3011224 the claimant asserted, in addition to her own losses, a salary loss on behalf of her husband.

Claims are paid in instalments and are made as soon as sufficient income has accumulated in the Compensation Fund.

First F4 instalment, claim No. 5000405.

In twofive of the individual claims identified as potentially overlapping with E4 claims, the Panel considers that the claim wass were not overlapping as the individual claimant was weres claiming losses that were related to the E4 claimant companies but were not overlapping losses (for example, where the individual claimant is seeking compensation for a loss of salary or management fee from the E4 claimant).

The average amount claimed for the claims in this instalment is about USD 2 million, compared to about USD 820,000 for all claims, about USD 934,000 for Jordanian claims and about USD 861,000 for Kuwaiti claims in the regular category D claims programme.

The median amount claimed is about USD 470,000 for claims in this instalment, compared with about USD 263,000 for all claims, about USD 335,000 for Jordanian claims and about USD 276,000 for Kuwaiti claims in the regular category D claims programme Approximately 75 per cent of the claims in this instalment contain D8 D9 business losses in relation to unincorporated establishments in Kuwait.

The Panel of Commissioners had itself noted that, although nearly all the claims for serious personal injury were supported by some form of proof, most of the claims contained a minimum level of documentary evidence.

Specifically, the secretariat, in valuing the claimant's D6 (loss of income) claim, incorrectly treated it as a duplicate of the claimant's C6 (salary loss) claim, resulting in an erroneous reduction of the amount of compensation awarded to the claimant for his C6 claim.
