8. A nuclear explosive device means any device capable of bringing about a nuclear chain reaction of explosive fission, for example, a nuclear weapon or a nuclear experimental device.

Incorporation of fail safe, sterilization, self destruct features, et cetera, should be considered (reference STANAG 4187).

The three underground nuclear tests carried out at 1545 hours on 11 May were with three different devices a fission device, a low yield sub kiloton device and a thermonuclear device.

(a) Any nuclear explosive device

A person who (a) possesses a nuclear explosive device or (b) has control over a nuclear explosive device

The States parties recall that the nuclear weapon States reaffirmed their commitment not to transfer to any recipients nuclear weapons or other nuclear explosive devices, or control over such weapons or explosive devices, directly or indirectly, and not, in any way, to assist, encourage or induce any non nuclear weapon States to manufacture or otherwise acquire nuclear weapons or other nuclear explosive devices, or control over such weapons or explosive devices.

For the purpose of this Act, nuclear weapons include nuclear explosive devices that are not intended for use as a weapon.

The consignor shall verify that the closures and equipment are not leaking.

(j) To delete paragraph 8, defining the term nuclear explosive device

38. A nuclear weapon free zone should provide for the effective prohibition of development, control over or possession of any nuclear explosive device for any purpose by States parties, and should provide for States parties not to allow the stationing in the zone of application of any nuclear explosive device.

s8(2) A person who acquires a nuclear explosive device is guilty of an offence against this subsection.

s11. A person who stations, or does any act or thing to facilitate the stationing of, a nuclear explosive device in Australia is guilty of an offence against this section.

One such step should be a convention banning the production of fissile material for nuclear weapons or other nuclear explosive devices.
