95. On 18 March 1996, the Rapporteur transmitted an urgent appeal to the Government of Colombia, concerning death threats against Mrs. Margarita Arregoces and a human rights lawyer Mr. Reinaldo Villalba Vargas of the Lawyers apos Collective (Corporación Colectivo de Abogados).

549. Osmán José Colina Hernández, Carlos José González, Juan José Villamizar, Guillermo Tamayo Rivas, Luis Gerónimo Velásquez, José Vargas Pérez and Ulises López Galantón, who were arrested by the National Guard on 17 October 1995 while taking part in a demonstration at the University of Carabobo.

The message containing the threats was reportedly signed by a paramilitary group called COLSINGUE, and was also considered to be an indirect threat against Mr. Villalba Vargas who is defending Mrs. Arregoces in a trial which was initiated against her by the regional public prosecutor apos s office of Santafé de Bogotá.

At the 23rd meeting, on 2 April 1996, the Chairman Rapporteur of the working group on the draft optional protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, Mr. Carlos Vargas Pizarro, introduced the report of the working group (E CN.4 1996 28 and Corr.1).

Mine Zenaida Vargas Lázaro, a 14 year old Yanesha native, was detained on 1 March 1997 by army personnel from the command post of Alto Comaina Counter subversion Battalion No. 79, based in the locality of Villa Rica, Oxapampa province, Department of Cerro de Pasco, in the house where she was working in Villa Rica.

But most observers seem to believe that his support was crucial in bestowing a mantle of legitimacy and democratic disposition on Humala, who in 2007 ran on an unabashedly pro Hugo Chávez platform. And Alvaro Vargas Llosa, Mario s son, has been helping Humala convince financial markets and the international community that he is now a true believer in capitalism.

Humala drew more votes than all of his rivals in the first round of the presidential election, but had to face Fujimori s daughter, Keiko, in a run off. Vargas Llosa initially declared that the choice was between AIDS and cancer, but later secured commitments from Humala on economic policy, democratic rule, and a one term administration.

Exit polls did not measure the Vargas Llosa effect, so it is difficult to say whether his backing was decisive in Humala s victory (the margin was less than 2 ). But most observers seem to believe that his support was crucial in bestowing a mantle of legitimacy and democratic disposition on Humala, who in 2007 ran on an unabashedly pro Hugo Chávez platform.

4. In the context of the information received and having examined the available information, the Working Group, without prejudging the nature of the detention, decides to file the cases of Carlos José González, Osmán José Colina Hernández, Guillermo Tamayo Rivas, Juan José Villamizar, Luis Gerónimo Velásquez and José Vargas Pérez under the terms of paragraph 14.1 (a) of its methods of work.

This persistence is best reflected in the role that Nobel Prize winning novelist Mario Vargas Llosa plays in his native Peru. He was, of course, always an engagé in the early 1960 s, when he supported the Cuban Revolution when he later became one of Fidel Castro s most ferocious and effective critics and when he ran for Peru s presidency in 1989 (losing to Alberto Fujimori).

Vargas Llosa argued eloquently and elegantly that he could not vote for the daughter of a corrupt and repressive former president currently serving a 25 year prison sentence for human rights violations. But nor could he abstain or call for others to do so, since this would not only favor Keiko, but would also be a de facto abdication of the intellectuel engagé s responsibility.
