The matter has been brought to the attention of the internal WHO Working Group on Organ Transplantation, as well as to that of the members of the WHO Task Force on Organ Transplantation.

40. According to information received from the Institute of Health Law of the University of Neuchâtel, several Swiss cantons have already incorporated relevant guidelines into their regulations on organ transplantation.

The transplantation of solid organs, such as kidneys, livers, hearts or lungs, has gradually become a regular component of health care systems in many countries and not only in developed ones.

Over the past 40 years, organ transplantation has been transformed from an experimental procedure carried out in advanced medical centres to a therapeutic intervention performed in hospitals and clinics throughout the world.

Instead of medicalizing and ethicalizing it, let us direct our main efforts at draining the swamp. Organ transplantation, like mosquito repellent, should be used sparingly, and only when there is no other choice.

6. We also believe that a ban should be imposed on operations that threaten the human nature of persons, such as the transplantation of organs from mammals into the bodies of human beings.

173. The main cause is the colonial heritage, for frontiers were drawn between various colonies regardless of the borders recognized by the original ethnic groups, and this situation was aggravated by the transplantation of populations.

Exploitation under paragraph 1 of this Article specially includes exploitation of others through prostitution or other forms of sexual exploitation, forced labor or provision of services, slavery or procedures similar to slavery, serving under force or removal of organs for the purpose of transplantation.

WHO, in particular, has since 1991 endorsed a set of Guiding Principles on Human Organ Transplantation, which put emphasis on voluntary donation, non commercialization and generic relation of recipients to donors and recommended that organs preferably be obtained from cadavers rather than from living donors.

Despite the strong tradition that organs and tissues should be regarded as gifts, some members of the transplant community and policy makers in several countries have expressed interest in allowing financial incentives for the provision of human body parts, thus hoping to increase access to transplantation.

Requests the Special Rapporteur, within the framework of her mandate, to continue to pay attention to issues relating to the traffic in children, such as organ transplantation, disappearances, the purchase and sale of children, adoption for commercial purposes or exploitation, child prostitution and child pornography

Unfortunately, much of the world transplant establishment including the WHO, the international Transplantation Society, and the World Medical Association advocates only a partial remedy. They focus on ending organ trafficking but ignore the time tested truth that trying to stamp out illicit markets either drives them further underground or causes corruption to reappear elsewhere.

445. In order to implement these objectives, detailed health programmes have been developed. They include protection against heart disease, combat against tumoral diseases, health care of mother and child, combat against tuberculosis and diabetes, dental care for children and youth of school age, improvement and development of dialysis therapy, kidney and bone marrow transplantation.

To decide whether selling prison cell upgrades corrupts the meaning of criminal justice, we have to decide what purpose criminal punishment should serve. To decide whether we should allow the buying and selling of human organs for transplantation, or hire mercenaries to fight our wars, we have to think through hard questions about human dignity and civic responsibility.

24. Encourages the World Health Organization to continue to pay special attention to this issue, welcomes once again the recommendation of the World Health Organization Advisory Committee on Health Research to set up a task force on organ transplantation, and notes the report of its first meeting held in Annecy, France, on 10 and 11 October 1996

The artificial heart machine, also known as a left ventricular assist device, or LVAD, has been used to keep patients alive until they receive a heart transplant. But there is a shortage of hearts for transplantation, and in the US, LVADs are now being implanted as a long term treatment for heart failure, just as a dialysis machine replaces a kidney.
