The Panel has made recommendations with respect to the remaining personal losses asserted in these claims.

Receivables Seven of the claims in this instalment seek compensation for receivables for a total asserted value of KWD 852,471 (approximately USD 2,949,727).

Notwithstanding the verified business licences, the Panel recommends no award of compensation for the asserted business losses in each of these three claims.

Tangible property Sixteen of the stand alone claims seek compensation for tangible property losses for a total asserted value of KWD 4,545,213 (approximately USD 15,727,381).

Other losses Twelve of the claims in this instalment seek compensation for other losses for a total asserted value of KWD 409,306 (approximately USD 1,416,284).

The Panel finds that two of the claims do not meet the criteria for compensability of the asserted losses, while another is a duplicate claim.

They argue that, under the settled principles of international law, loss of life and reduced quality of life of nationals of a State represent injuries to the State, and claims for such injuries can be asserted as State claims rather than as the claims of individual nationals.

Loss of profits Fourteen of the claims in this instalment seek compensation for loss of profits for a total asserted value of KWD 1,278,108 (approximately USD 4,422,519).

While the claimants in this instalment claimed for D2 and D3 losses more frequently than claimants in the regular category D claims programme and asserted higher claimed amounts, 103 of the 117 claims are not recommended for compensation as the claimants failed to prove the essential requirements of ownership, loss or causation.

During the regular category D claims programme, non Kuwaiti claimants asserted losses in relation to businesses they owned and operated under rent a permit agreements with the licence holders.

In those cases, the E4 Panel recommended no compensation for the claims when they were reviewed, as the E4 claimants had not submitted sufficient information or documents to support their asserted losses.

Of the 24 company claims in this instalment, 19 are stand alone claims four are corporate detainee claims and one is an E2 claim.

Fifth, for some claims in this instalment the audited financial statements were the only third party evidence submitted to substantiate the existence and ownership of the business and the quantum of the asserted losses.

For the reasons set out in paragraphs 34 37 of the Special Overlap Report and in paragraphs 22 25 below, the Panel considers that, although these claims appeared upon initial review to have some indicia of an overlap relationship, there was no actual overlap between the losses asserted in those claims.

It is a fact that all but a handful of what are asserted to be rights are essentially contested concepts.

These claims are discussed below.

Of these claims, the Panel recommends awards of compensation for two claims, while no awards are recommended for the remaining 16 claims.

In the absence of satisfactory evidence of the existence of the business as at 2 August 1990, the Panel recommends no awards of compensation for the asserted business losses in these claims, which total approximately USD 45 million.

Of the 19 claims, 18 were deferred for determinations in respect of stand alone, overlapping and competing business claim issues and for investigation of potential irregularities in the documentation provided by claimants in support of their asserted business losses.

This global approach was suited to the specifics of category C claims processing, as category C claims are subject to mass claims processing procedures and are not subject to extensive individual review or claim development.

With regard to Iraq's contention that some of the claims are for indirect losses, the Claimants state that these claims are not for indirect losses since, by their very nature, they can only be claims of the State.

That doesn't mean that Russia's claims are all false.

No overlap due to the nature of the loss asserted

At a Conference organized by JFBA in October 2004, it was asserted it is obvious that there are wrongful convictions among capital cases .

The Palestinian and Jordanian claimants each asserted a one sixth interest in the businesses as at 2 August 1990 while the Kuwaiti claimant asserted that she was their sole owner.

After these transfers and additions, the claims remaining in the thirtieth instalment therefore relate to 25 claims for the losses of 24 companies and are hereinafter referred to as the claims in this instalment .
