3.1.8 Reservations to a provision that sets forth a customary norm

A reservation to a treaty provision which sets forth a customary norm does not affect the binding nature of the customary norm in question in relations between the reserving State or international organization and other States or international organizations which are bound by that norm.

It is clear that consensus would have facilitated the process of establishing a universal customary norm.

The compatibility of a reservation with the object and purpose of the treaty was a customary norm, although it was not a peremptory norm of international law.

One example is the absolute prohibition on the use of torture, a norm so widely accepted as to have the status of customary international law.
