Some provisions of the draft convention could prove difficult to reconcile provisions of Directive 2000 31 EC

Article 14 of the draft convention and article 11 of the directive risk creating inconsistencies between Community provisions and the Convention.

The Working Group had been aware that draft article 6 was based on a similar provision in the European Union Directive.

Mr. Carvell (United Kingdom) said that the proposed clause provided a vehicle for reconciling potential differences between the draft convention and the European Union Directive.

During the referendum campaign in France preceding the vote on the draft EU Constitutional Treaty, the proposed directive was vilified as undermining the rights of labor, symbolized by that dreaded bogeyman, the Polish plumber.
