The draft law establishes under what circumstances a financial transaction is subject to special oversight (in other words, is considered a suspicious financial transaction ).

(k) Financial contract means any spot, forward, future, option or swap transaction involving interest rates, commodities, currencies, equities, bonds, indices or any other financial instrument, any repurchase or securities lending transaction, and any other transaction similar to any transaction referred to above entered into in financial markets and any combination of the transactions mentioned above

AMLO has received some suspicious transaction reports from financial institutions.

Where there is any significant change to the economic environment after the latest transaction day, the enterprise concerned shall adjust its market quoted price of the latest transaction by referring to the available prices or interest rates of similar financial assets or financial liabilities so as to determine the fair value of the said financial asset or financial liability.

Financial institutions have the legal obligation to urgently report transactions suspected to involve terrorist activities to AMLO as a suspicious transaction within 7 days from the date of executing the transaction.

By making decision making processes, performance data, transaction processing, and general information about the Organization more accessible, the United Nations becomes more accountable to Member States, staff and civil society.

Regarding currency transaction report, Central Bank Circular Letter 3098, from June 11th, 2003, established these obligations for financial institutions (banking and non banking financial institutions).

The draft law includes provisions obliging persons performing a financial transaction to register any transaction subject to special oversight on a special form within the working day upon learning that special oversight applies.

Financial institutions have also been advised to remain vigilant against any illicit financial transaction, which should be reported to the Royal Monetary Authority (RMA) for further investigation.

Where the enterprise has adequate evidences to prove that the market quoted price of the latest transaction is not a fair value, it shall make appropriate adjustment to the market quoted price of the latest transaction so as to determine the fair value of the said financial asset or financial liability.

Article 31The transaction expenses refers to the newly added external expenses attributable to the purchase, distribution or disposal of a financial instrument.

Financial institutions are required to report transactions if the transaction involves more than US 10,000 and appears to have an unlawful purpose.

Article 30 of Supreme Decree No. 24771 sets out the obligation of financial entities to submit Suspicious Transaction Reports to the FIU.

According to the international financial reporting standards conceptual framework, the substance of any economic transaction should take precedence over its legal form.

It is proposed that the control functions relating to the processing of financial accounting records be regrouped within the Accounts Unit.

(d) Simplification of the administration of transaction and lower transaction costs.

More specifically, a financial transaction, whether completed or not, is subject to special oversight if one or more of the following conditions is met

There is information that the person performing the financial transaction is involved in terrorist activity or is directed by persons involved in terrorist activity.

If the transaction fails the transaction should be closed with ROLLBACK or ABORT.

Article 53As for the financial assets initially obtained or produced at source and the financial liabilities assumed, the fair value thereof shall be determined on the basis of the transaction price of the market.

In its regulatory role, the Financial Intelligence Unit maintains standing committees that ensure that the providers of financial transaction reports are consulted regarding the implementation and operation of the relevant provisions of the legislation.
