In most jurisdictions bids are binding on bidders and withdrawal of bids may be subject to the forfeiture of a bid security, if any.

1.2 The CTC would appreciate knowing whether the draft Law on Forfeiture of Criminal Assets, approved by the Council of Ministers in February 2004, has become law.

However, this forfeiture has been significantly curtailed by article 45 (3) of Additional Protocol I and may likewise be mitigated by protections under human rights law prohibiting prolonged incommunicado detention in all circumstances.

Thus, judicial authorities no longer may but are obliged to order forfeiture of a thing if the circumstances of the case warrant a reasonable assumption that it could be used to finance terrorism.

A continuing challenge facing several States in the investigative, prosecution and trial phases was the lack of financial resources and trained personnel with the operational know how required to achieve the forfeiture of assets.

A specialized prosecution unit had also been established at the Office of the Attorney General to prosecute terrorism and money laundering cases and to deal with the forfeiture of assets emanating from terrorist activities.

The Office of the High Representative also completed a survey of criminal and civil asset forfeiture laws in order to support efforts by the Ministry of Justice to find practicable solutions for dealing with the proceeds of crime.

In paragraph 190, the Board recommended that UNFPA perform reasonable advance planning, management flexibility and proper succession planning across all of its units in order to avoid the forfeiture by staff of excess leave and to improve the control environment.

Clause 36 would empower the Director of Public Prosecutions to apply to a judge in Chambers, where he has reasonable grounds to believe that there is property in a building, place or vessel in respect of which a forfeiture order may be made under clause 37, for a warrant authorizing a police officer to search for and seize the property, if found.

These reports have been analysed and investigated in cooperation with the law enforcement agencies concerned. If there is enough evidence to believe that natural persons or juridical persons are involved in or support terrorist activities, AMLO will use civil asset forfeiture measures against the assets and will provide information to the Department of Special Investigation to file the criminal charge against these persons.

Article 142 Anyone who violates the provisions of this Law, and illegally transacts insurance agent business or insurance brokerage business without an insurance agent license or insurance broker license, shall be subject to action by the financial supervision and regulation department, and forfeiture of illegal gains, and a fine of not less than five, nor more than ten times as much as the illegal gains.
