Malaria contributes to a significant proportion of deaths, miscarriages and incidences of anaemia, low birth weight and still birth.

225. In terms of clinical causes, 38 per cent of deaths were due to miscarriages and 21 per cent to septicaemia.

3.3 The authors claim that the proceedings as a whole have lasted nearly 15 years (1985 2000) and that successive miscarriages of justice have contributed to this unreasonably lengthy process.

It recommends to the State party that it identify any miscarriages of justice which may have occurred and been motivated by the ethnic origin of the defendants and that it redress any injustice done.

Cases of cancer, asthma bronchitis, goitre and heart disease as well as miscarriages, loss of hair, and eye, skin and mental diseases among the inhabitants of the area seem to be increasing and apparently, accounts are not kept of medical investigations.

5.2 The authors state that they have spent years drawing attention to the miscarriages of justice, errors and irregularities to which they have been exposed and that they have taken specific complaints of violations of the right to a defence and of the principle of adversarial proceedings all the way up to the Court of Cassation.

4.7 As to the lack of a fair hearing, and with reference to the miscarriages of justice alleged by the authors, in the State party's view an error by a court does not constitute a culpable miscarriage of justice within the meaning of article 14 of the Covenant, to the extent that it arises in the course of a judicial process that also allows for its rectification.
