There was a need for legally binding security assurances to non nuclear weapon States.

(i) A non legally binding instrument such as an enriched and stronger version of the current international arrangement on forests

The Working Group had the role of determining standards of a legislative kind along with non legally binding kinds of guidelines.

However, this practice would not be legally binding.

It also supported the negotiation of a universal and legally binding instrument that provided security guarantees of non use of nuclear weapons against non nuclear weapon States.

Option 2 A non legally binding instrument (NLBI) such as an enriched and stronger version of the current International Arrangement on Forest

1. Decides to adopt the non legally binding instrument on all types of forests as contained in the annex to the present resolution

If legally binding security assurances were given by the five nuclear weapon States to non nuclear weapon States, it would avoid unnecessary insecurity.

It was equally important to continue the development of a universal and legally binding instrument on security assurances to non nuclear weapon States.

If the legally binding component has failed to ensure the enforcement of these rights in these Covenants, what is the point of having another legally binding right ?

Recognizing the need for a multilaterally negotiated and legally binding instrument to assure non nuclear weapon States against the threat or use of nuclear weapons,

The reports point out that a legal instrument and a non legally binding approach would be very similar in terms of objectives, goals and principal targets and also note that a legally binding instrument would strengthen the political commitment to sustainable forest management and give forest issues high political visibility.

They reiterate the agreement at the 2000 Review Conference that legally binding security assurances by the five nuclear weapon States to the non nuclear weapon States strengthen the nuclear non proliferation regime.

Early conclusion of a universal, unconditional and legally binding instrument on security assurances to non nuclear weapon States should be given attention at the Review Conference.

Furthermore, a legally binding instrument on negative security assurances to non nuclear weapon States should be pursued as a matter of priority by the international community.

These steps could take the form of an internationally legally binding instrument.

Legally binding security assurances by the nuclear weapon States to the non nuclear weapon States parties to the NPT would significantly strengthen the nuclear non proliferation regime by eliminating incentives for pursuing capabilities.

India believes that multilaterally negotiated and legally binding instruments provide the best mechanisms to deal with disarmament and non proliferation issues, including the proliferation of ballistic missiles.

(d) The Conference agrees that legally binding security assurances by the five nuclear weapon States to the non nuclear weapons States parties to the Treaty on the Non Proliferation of Nuclear Weapons strengthen the nuclear non proliferation regime.

The failure of Copenhagen was not the absence of a legally binding agreement.

What we need is a legally binding international instrument that will regulate, control and monitor the illicit trade in small arms, including their transfer to non State actors.

Lastly, while recognizing that nuclear non proliferation and disarmament required the negotiation and adoption of legally binding multinational instruments, Switzerland did not with to exclude other, complementary initiatives.

In the discussion following these presentations, questions were raised with regard to the issue of accountability, as the Millennium Development Goals were not legally binding but were linked to legally binding international human rights instruments.

Although the Programme is not a legally binding document in itself, many of the important issues addressed therein such as the right to health and employment issues are already included in existing, legally binding international instruments.

Japan has been actively taking part in international efforts to encourage universal adherence to these multilateral legally binding instruments on disarmament and non proliferation of weapons of mass destruction.

The Convention contains clear, legally binding commitments, as well as provisions to ensure compliance.

Canada supports beginning discussions on codifying negative security assurances on a legally binding basis.

The disarmament process should be carried out within the framework of legally binding instruments.

(b) Non binding recommendations

What is still needed, however, is a legally binding international instrument that will regulate, control and monitor the illicit trade in small arms, including their transfer to non State actors.

We are convinced that legally binding security assurances provided by the five nuclear weapon States to the non nuclear weapon States would strengthen the nuclear non proliferation regime, and advocate the commencement of negotiations to this end.

International cooperation in this area can take place either on an informal basis, or in pursuit of the application of an international instrument (the term instrument is used here to cover both legally binding treaties or agreements and non binding recommendations or undertakings).
