Often, the project sponsors will establish an independent legal entity to carry out the project, and with which the host Government will conclude a project agreement.

There was general agreement that legislative approval did not mean that parliament would be called upon to modify individual provisions in the project agreement.

The expressions concession agreement and concession contract are used in some legal systems to refer to the agreement between the host Government and the project company or consortium setting forth the conditions for the implementation of the project.

The legislation may help the parties to achieve a timely conclusion of the project agreement by identifying essential issues that need to be dealt with therein (for further discussion of this topic, see chapter VI, The project agreement ).

Given the complexity of infrastructure projects, the project company is likely to retain one or more contractors for performing the works under the project agreement.
