Provisional Agreement on Children Returnees

The Preparatory Committee had not reached an agreement on a provisional agenda for the Conference.

(a) An agreement on item 16 of the provisional agenda of the Review Conference, which would be as follows

On 5 March 2002, the Entity ministers of education signed the Provisional Agreement on Meeting Special Needs and Rights of the Returnee Children.

The Agreement, which came into effect on 8 May, establishes a provisional borderline covering approximately 96 per cent of the entire land border.

Separate provisional agendas for COP 11 and for COP MOP 1 will be prepared by the secretariat, in agreement with the President of the COP.

Strongly welcoming the successful conclusion of the agreement reached among various Afghan groups in Bonn, Germany, on 5 December 2001,Agreement on Provisional Arrangements in Afghanistan Pending the Re establishment of Permanent Government Institutions (see S 2001 1154).

Likewise, the Tribunal is empowered to order provisional measures pending agreement between coastal States and fishing States as concerns the conservation and management of straddling stocks.

Rule 9 of the draft rules of procedure being applied provides In agreement with the President, the secretariat shall draft the provisional agenda of each session .

We welcome the agreement signed recently between MINUSTAH, the Transitional Government, the United Nations Development Programme and the Provisional Electoral Council on the organization of the elections.

Requests the Secretary General to prepare a draft provisional agenda and draft rules of procedure for the review conference, and circulate them at the same time as the provisional agenda, proposed by the fourth round of informal consultations of States parties to the Agreement, for the fifth round of informal consultations of States parties to the Agreement, 60 days in advance of these consultations

It is interesting to note that the straddling fish stocks Agreement has modified the Tribunal's competence to prescribe provisional measures, since it allows the Tribunal to prescribe provisional measures not only to protect the rights of the parties, but also to prevent damage to the fish stocks in question.

The provisional agreement ensures the condition for employment of more returnee teachers and specifies that the ethnic composition of the school boards has to reflect the ethnic composition of the local population.

Accordingly, any reference in this Agreement to signature, ratification, acceptance or approval, or to notification of provisional application, or to accession shall, in the case of such organizations, be construed as including a reference to signature, ratification, acceptance or approval, or to notification of provisional application, or to accession, by such organizations.

The provisional agreement also specifies that the ministries of education need to issue the implementation instructions and designate representatives of their ministries, who would be responsible for resolving the problems of the returnee children.

If, before the expiry of the ten year period referred to in paragraph 1 of this article, or before the expiry of an extension period referred to in paragraph 2 of this article, as the case may be, the new Agreement to replace this Agreement has been negotiated but has not yet entered into force either definitively or provisionally, the Council may, by special vote, extend this Agreement until the provisional or definitive entry into force of the new Agreement.

In 1993, in secret bilateral negotiations in Norway (unknown to the Americans), Israel and the PLO reached an agreement about mutual recognition and the creation of a provisional Palestinian Autonomous Authority. Yet some issues remained unresolved.

Argentina signed in December 1999 and ratified in February 2004 an agreement on the International Monitoring System under CTBT with the Provisional Technical Secretariat of the Preparatory Commission for the Comprehensive Nuclear Test Ban Treaty Organization.

Convinced that the main responsibility for finding a political solution lies ultimately with the Afghan people themselves, and strongly welcoming and endorsing therefore the agreement reached among various Afghan groups in Bonn, Germany, on 5 December 2001,Agreement on Provisional Arrangements in Afghanistan Pending the Re establishment of Permanent Government Institutions (see S 2001 1154).

Over more than 10 years of deliberations, the Working Group has reached provisional agreement on a large number of issues under cluster II however, substantial divergence of views remains on other issues, including issues in cluster I.
