1. Health insurance (medical care, cash sickness benefits)

Under the Law On Maternity and Sickness Insurance a sickness benefit is granted and paid in the amount of 80 of the insured person's monthly average insurance contribution wage.

Sickness and maternity insurance occupational risks insurance invalidity and life insurance retirement, cessation of employment at an advanced age and old age insurance, and day care and social benefits insurance.

The purpose of the fund is to finance accident, sickness and maternity insurance benefits.

Maternity insurance is regulated by the Law of 6 November 1995 On Maternity and Sickness Insurance (became effective as of 1 January 1997).

A social long term care insurance has been introduced under the aegis of the sickness funds.

150. Sickness allowances are the main social insurance benefit granted to all groups of people insured.

Sickness benefit The sickness benefit in material terms is a health care (at hospitals and out patient clinics, including pharmaceutical products and dentistry for children), which is financed from the state budgetary resources in its turn, the sickness benefit in financial terms is the state social insurance benefit which is granted and paid in view of the setting in of an insurance case temporary inability for work in accordance with the Law On Maternity and Sickness Insurance.

156. The sickness insurance also includes a rehabilitation benefit, which is granted to all groups insured, except individual farmers.

In accordance with the Law On Maternity and Sickness Insurance the maternity benefit is granted in the amount of 100 of the average insurance contribution wage of the beneficiary.

The difference is also payable to employees who are not insured against sickness or who have private health insurance coverage.

141. In Sri Lanka, cash sickness benefit programmes are not organized on the basis of insurance funded by payroll contributions.

Article 10 of the Law On Maternity and Sickness Insurance provides that the maternity benefit is granted in the 100 amount of the average insurance contribution wage of the beneficiary.

240. The social insurance benefits referred to earlier in this report (with the exception of sickness allowances for workers in socialized establishments) are financed from a separate Social Insurance Fund.

Maternity benefit Under the Law On Maternity and Sickness Insurance of 6 November 1995 a person, upon leaving for the maternity leave, is granted a state social insurance benefit the maternity benefit.

This modern concept is also reflected in the currently applicable catalogue of benefits. On the basis of this catalogue, the statutory health insurance has to provide the following benefits promotion of health prevention of sickness treatment of sickness medical rehabilitation payment of sickness benefits payment of death grants.

The sickness benefit paid is equal to 80 of the average monthly wage from which the insured person is making insurance contribution.

The basis of calculation of the sickness allowances would include those components of remuneration on which a social insurance contribution was paid.

Starting from the thirty sixth day of sickness during a year the sickness allowance would be financed wholly from social insurance and would be payable at the rate of 80 per cent of the basis of calculation

The artists apos social fund transfers the contributions to the insurance funds (Federal Insurance Institute for Salaried Employees, local sickness fund or substitute fund, long term care insurance fund) which provide the regular benefits for artists and publicists if the contingency arises.

155. In the Polish sickness insurance system, special provisions allow certain professional groups (academic teachers, judges, public prosecutors, employees of research units) to retain the right to remuneration for up to one year in the case of sickness.

154. In the case of certain groups of insured persons a waiting period is required to acquire the right to the sickness allowance (for example agents acquire the right to the sickness allowance after six months of uninterrupted insurance).

The average insurance contribution wage for the calculation of the sickness benefit must not exceed 50 of 1 365 of the annual maximum amount of the state social insurance compulsory contribution object that was in effect on the date when the insurance case occurred.

In the event of sickness, an insured person may thus claim benefits of the statutory health insurance without having to pay for them directly since the sickness funds have concluded contracts with the so called service providers such as doctors, hospitals, pharmacies, etc. which require the latter to treat an insured person in the event of sickness at the expense of the sickness fund.

The Committee is concerned that only a limited percentage of the Ecuadorian population is entitled to social security benefits, especially to sickness and maternity insurance.

The Act of 17 December 1974 concerning cash social insurance benefits in respect of sickness and maternity (uniform text Dziennik Ustaw of 1983 No. 30, Text 143, with amendments) is the basic legal act regulating sickness allowances. It is called the Allowance Law.
