Relevant Federal legislation includes the Quarantine Act 1908, the Crimes Act (Biological Weapons)1976, the Chemical Weapons (Prohibition) Act 1994, the Weapons of Mass Destruction (Prevention of Proliferation) Act 1995, the Criminal Code, and the Customs Act 1901.

The Weapons of Mass Destruction Act 1995

Please see pages 5 and 6 of Australia's Report on the Implementation of UN Security Council Resolution 1540 (the Report) detailing the Nuclear Non Proliferation (Safeguards) Act 1987, the Chemical Weapons (Prohibition) Act 1994, the Crimes (Biological Weapons) Act 1976 and the Weapons of Mass Destruction (Prevention of Proliferation) Act 1995.

The UN Firearms Protocol will be implemented in the Weapons and Ammunition Act.

In 2003, Mauritius enacted the Chemical Weapons Convention Act 2003 (Copy at annex 1)

(a) The Strategic Goods (Control) Act, the Regulation of Imports and Exports Act, the Chemical Weapons (Prohibition) Act, the Arms Offences Act and the Arms and Explosives Act adequately prohibit non State actors from carrying out activities that would contravene Security Council resolution 1540 (2004)

Weapons and trade in weapons in Tunisia are subject to close security control and are regulated under Act No. 33 of 1969 concerning the classification, acquisition, marketing, repair and carrying of weapons.

Under section 6A of the Crimes (Biological Weapons) Act, Chapter 2 of the Criminal Code Act 1995 (the Criminal Code) applies in relation to these offences.

However may the substances the Act applies to, in principle be used to produce such weapons.

In 2004, Mauritius enacted the Biological and Toxin Weapons Convention Act 2004. (Copy at annex 2)

In particular, section 8 of the Crimes (Biological Weapons) Act places a restriction on the development, production, stockpiling, acquisition or retention of certain biological agents and toxins and biological weapons.

In addition to those areas set out in the UK's first report, the Biological Weapons Act (BWA) 1974 Section 1 prohibits the development, production, stockpiling, acquisition and retention (possession) of biological weapons (BW) and their means of delivery further, through amendment under the Anti terrorism, Crime and Security Act (ATCSA) 2001 Section 43, it also prohibits the transfer and brokering of biological weapons.

Under the Chemical Weapons Convention Act 2003, the Mauritius National Chemical Weapons Authority has the duty of supervising the domestic implementation of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and their Destruction.

The Canadian Parliament passed the Biological and Toxin Weapons Convention Implementation Act which received royal assent on 6 May 2004.

For the purpose of this Act, nuclear weapons include nuclear explosive devices that are not intended for use as a weapon.

(1.8) Weapons are classified, in general, in accordance with Act No. 33 under five categories, three of which relate to firearms

With regard to the weapons regime, Senegal has national legislation pursuant to Act No. 66 03 of 18 January 1966 on the general weapons and munitions regime, which severely regulates all importation, exportation and transit of weapons and war equipment on the national territory.

Section 1 of the Act 6 May 1994 no. 10 relating to the implementation of the Chemical Weapons Convention makes it an offence to develop, produce, otherwise acquire, stockpile, transfer etc. chemical weapons in contravention of the Convention.

The Chemical Weapons (Prohibition) Act 1994 requires permit holders for production or use of CWC Scheduled chemicals to report their past and prospective annual activity.

The Weapons of Mass Destruction (Prevention of Proliferation) Act 1995 provides catch all controls for goods an dservices not regulated by the Prohibited Export Regulations.

The Chemical Weapons Act (CWA), which entered into force on 16 September 1996, prohibits the production (including manufacture), acquisition, possession (including stockpiling and storage), development, transfer, use and intention to use of chemical weapons and their means of delivery.

Biological, chemical and nuclear weapons are covered by the Military Equipment Act (SFS 1992 1300) and the Military Equipment Ordinance (SFS 1992 1303) as military equipment.

Part 6 of the Chemical Weapons (Prohibition) Act 1994 also outlines relevant offences associated with the production or use of Scheduled chemicals. These following sections are relevant

This Act prohibits the supply or export of goods that will or may be used in the provision of services that will or may assist, the development, production, acquisition or stockpiling of weapons capable of causing mass destruction or missiles capable of delivering such weapons.

Under article 1 of Act No. 29 of 1993, on hunting weapons and the related ammunition, moreover, it is prohibited for any person to possess, acquire, manufacture, trade in, import or export hunting weapons of any kind or the related ammunition unless duly licensed to do so.

Article 2 of the Convention, relating to terrorism and the criminalization of terrorist financing, matches articles 86 and 86 bis of Act No. 97 of 1992, amending the Penal Code and the Code of Criminal Procedure and concerning account secrecy and weapons and ammunition (known as the Terrorism Act ).

It is incumbent upon everyone in the international community to act without delay to prevent extremist circles from gaining access to materials which could be used as weapons of mass destruction.

The act, which will function to make it more difficult for terrorists to acquire and or use biological weapons, is framework legislation that streamlines existing laws that deal peripherally with biological weapons issues and thus provides a more complete legal basis for the regulation of dual use biological agents.

The protection of maternity in Estonia is guaranteed by the Employment Contracts Act, the Public Service Act, the Working and Rest Time Act, the Holidays Act, the Health Insurance Act, the Social Tax Act, the Child Benefits Act and the State Pension Insurance Act.

Act No. 213 II of 11 May 2001 on the transit of special cargoes and troops provides for monitoring of the carriage of dangerous cargoes, weapons, military technology, military property and troops.

Nor can it be assumed that Iran s divided and radical leadership would always act rationally, or that proliferation would stop with the Islamic Republic. If Iran develops its nuclear weapons, countries such as Saudi Arabia, Turkey, and Egypt would be tempted to purchase or develop nuclear weapons of their own.

The amendments to Decree Law 39 89, the Arms and Ammunition Act, are aimed at improving controls relating to illicit trafficking in and illegal possession of firearms ammunition, illegal bearing of explosives, chemical, biological and nuclear weapons and experimental weapons, and the stockpiling of and illegal trade in firearms and ammunition.

Last year, Pakistan's Parliament promulgated a comprehensive export control act, which further built upon the existing regime to deal with nuclear and biological weapons, materials, goods, technologies, equipment and their means of delivery.

The Internal Security Act 1984 (Chapter 133) has a provision to prohibit any non state actor to manufacture, acquire, possess, develop, transport, transfer or use nuclear, chemical or biological weapons for terrorist purposes.
