We note that the Tribunal's completion strategy involves a three step process encompassing the completion of investigations, trials and appeals according to the time lines established by the Security Council in resolution 1503 (2003).

In October 2004, the Special Court adopted its completion strategy on the basis of the operational information available at that time.

As set out in the Special Court's completion strategy, the completion of the Court's mandate will be carried out in two phases, namely, the completion phase and the post completion phase.

Separate trials would divert significant resources, including courtroom time, and therefore significantly impact on the completion strategy.

With the recent endorsement of the completion strategy by the Security Council, such attrition may become even more critical as the Tribunals approach the 2007 2008 time frame for the completion of their work.

There are three years to go before the deadline for completion by the two Tribunals of their first instance trials, as envisaged in their completion strategy. Three years is not a short period, and a great deal can be accomplished during that time.

At the time of the Secretary General's report in December 2004 (ibid.), the Court had anticipated completion of its trial activity by 31 December 2005.

This could leave the organizations in a vulnerable position and affect their ability to meet the time and quality demands of the completion of their mandate.

Both Tribunals have done the maximum possible to keep up with the time frame established in the completion strategies according to resolutions 1503 (2003) and 1534 (2004).

This new courtroom will enable more cases to be heard at the same time, thereby supporting the implementation of the completion strategy.
