The fifth F4 instalment includes a number of claims or parts of claims that were deferred from previous F4 instalments or transferred from other claims categories.

The sum insured refers to the maximum amount which the insurer undertakes to indemnify or pay under its insurance obligation.

Mission Claims processed from 19 May 1997

Two claims from Bangladesh, which had been erroneously identified as duplicate claims, should be reinstated since additional information received from the Government of Bangladesh demonstrates that the claims are, in fact, not duplicates.

Concerning the issue of duplicate claims, the secretariat indicated that it was aware of the risk of duplicate claims from the outset of claims processing and took steps to identify and eliminate such claims during the course of claims processing.

Liability insurance refers to an insurance the subject matter of the insurance of which is the insured's liability to indemnify a third party pursuant to laws.

With regard to claims for expenses resulting from public health expenditures, Iraq contends that there is no legal basis for such claims.

The total number of claims recommended for payment in the special instalment includes 602 claims originally filed as part of the 605 deceased detainee claims plus two claims for personal injuries resulting from landmine explosions filed pursuant to decision 12.

Some States attempt to refuse claims arising from acts of war .

Duplicate claims The Commission received information from the Government of Jordan that two claims were potentially duplicative of two other claims that were awarded compensation in category C Having reviewed the information received from the Government of Jordan, the secretariat confirms that the claims are, indeed, duplicates and should not have been awarded compensation.

This claim unit was deferred from the second instalment of F4 claims.

The data contained herein indicates the total number of claims received from troop contributing countries as at 30 September 1997, identifying the number of claims received since 19 May 1997, and shows the number of claims from the backlog that were processed in the period from 19 May to 30 September 1997.

The present report sets out the Panel's recommendations for a fourthsecond group of overlapping claims from resolved E4 instalments (the fourthsecond group of overlapping claims ).

In the interests of fairness, some jurisdictions allow for partial consolidation by exempting the claims of specific creditors and satisfying those claims from particular assets (excluded from the consolidation order) of one of the insolvent companies.
