Under the State Health Insurance Law, 5754 1994 ( State Health Insurance Law ), every resident is entitled to comprehensive health care services.

Pursuant to the Law On State Social Insurance, the Law On Social Security, the Law On Social Tax, the Law On State Pensions, the Law On Compulsory Social Insurance Against Unemployment, the Law On Insurance Against Accidents at Work and Occupational Diseases the receipt of the maternity benefit does not restrict receiving of any other benefit or social insurance services.

Article 30 The compliance department of an insurance company shall be responsible for organizing the study of the important supervisory documents circulated by China Insurance Regulatory Committee, make risk indications and put forward compliance suggestions.

Supervisory mechanisms

It is acquired by work, i.e. obligatory pension and disability insurance and voluntary insurance, as provided under the law.

In 1998, the Law On State Social Insurance became effective, introducing changes in the area of financing social insurance.

The law on health care insurance determines the system of mandatory and expended health care insurance, rights gained by this insurance, means of exercising these rights, and principles of private health care insurance.

In accordance with the Law On State Social Insurance, social insurance is compulsory also for persons who receive maternity benefits.

Acts regulating the social insurance of population groups other than workers refer to the Allowance Law governing workers apos insurance.

Article 130 The provisions of Article 105, 107 and 117 of this Law shall apply to insurance agents and insurance brokers.

Rights to pension and disability insurance are defined by law as follows

Generally, applicable provisions of procurement law may apply, for instance suspension may be ordered by a court or supervisory authority.

Article 5 Legal entities engaged in commercial insurance must be insurance companies established in accordance with this Law no other entity or individual is permitted to transact commercial insurance business.

Supervisory and regulatory arrangements

Maternity insurance is regulated by the Law of 6 November 1995 On Maternity and Sickness Insurance (became effective as of 1 January 1997).

The above Law introduced several significant changes in the area of financing social insurance.

At the same time, in order to completely regulate the insurance legislation, a range of regulations are envisaged to be adopted deriving from the Law on Insurance, which will make the insurance legislation more comprehensible.

It is this Law that established that all citizens are covered under mandatory health care insurance, in accordance with the Law.

However, the Supervisory Authority would consider whether a general policy of rejection on the basis of language was in accordance with Danish law.

In its turn, the Law On State Social Insurance of 1 October 1997 provides that all employees and the self employed are subject to maternity insurance.

The term compliance risk as referred to in the present Guidelines means the risk of undertaking legal responsibility, supervisory punishment, financial losses or reputation losses as a result of an incompliant insurance operation and management behavior made by the insurance company or any of its employees and marketing staff.

Rights to pension or disability insurance are acquired and exercised under conditions stipulated by law.

By act of law, everyone who was insured with a social insurance fund of the former GDR was covered by the statutory health insurance in the new Länder.
