RECOMMENDATIONS ON MULTIMODAL TANK TRANSPORT

The least developed countries faced a worrying situation with regard to the development of multimodal transport, and challenges included the limited availability of transport equipment, precarious infrastructure, and complex and onerous administrative procedures.

There has been close cooperation with ESCAP in the area of transport and shipping for many years, starting in ports and expanding to freight forwarding, multimodal transport (MT) and Electronic Data Interchange (EDI).

UNCTAD also cooperates with OAU through its technical assistance projects for the sub sectoral working group of the second United Nations Transport and Communications Decade for Africa through its TRAINMAR programme and through a series of courses on multimodal transport.

A question was raised as to whether draft article 89(a) would introduce exemption of liability in the non maritime legs of the carriage in case of multimodal transport.

It also noted that AITD had established a training centre on multimodal transport and had trained operational personnel in Nepal and intended to provide training for Bangladesh and Myanmar.

A multimodal transport workshop was carried out in cooperation with ESCWA in 1994, joint TRAINMAR training exercises have been conducted and a joint trade facilitation project is under consideration.

The TRAINMAR Programme was created in 1980 to respond, in cost effective and practical fashion, to the large demand in the developing countries for qualified managers in the fields of shipping, ports and multimodal transport.

This included development of organizational structures, of preparation of a comprehensive Maritime Code, including a Port Act development of human resources through programme training (TRAINMAR), and, advice on technical matters, including international maritime and multimodal transport.

A concern was expressed that under the network system for multimodal carriage adopted in the draft instrument, draft article 88a (5) might introduce in the contract of carriage derogations also to international transport agreements not relating to maritime transport, and that this result would conflict with mandatory rules of international law.
