Plant operators and national regulators are being scrutinized more critically. Countries are opening their plants to more amp 160 and more thorough international safety reviews.

Endless discussion of the coexistence of genetically engineered and conventional organisms has reinforced the stigma, leading activists to pursue frivolous yet damaging litigation. For example, in at least four lawsuits brought against regulators in the United States, judges initially ruled that regulators had failed to comply with the procedural requirements of the US National Environmental Policy Act.

Nor do the memoranda of understanding drawn up by national financial regulators offer hope of salvation. According to the FMLC paper, they are usually the subject of interpretative disagreement, are not legally binding, do not benefit from any binding dispute resolution mechanisms, and do not prevent national authorities from acting unilaterally.

These codes are typically aimed at a range of actors, including governments, national regulators, corporations, and individual scientists, farmers and other workers. They deal with items (e.g. pesticides) that could potentially involve, or be diverted to, biological weapons.

The revolution in transport and communications, we hear, has vaporized borders and shrunk the world. New modes of governance, ranging from transnational networks of regulators to international civil society organizations to multilateral institutions, are transcending and supplanting national lawmakers.

Regulators may well need to turn to bankruptcy laws to fix the problem. The regulators call to the ISDA for voluntary action will not amount to much if it is just a request to the derivatives industry to act against its own financial interests.

The broader implication is that we need to look beyond greedy bankers and spineless regulators (and there were plenty of both) for the root causes of this crisis. And the problems are not solved with a financial regulatory bill entrusting more powers to those regulators.

There seem to be good reasons for organizing regulators as general rather than sector specific agencies (moreover, some of the difference in performance expected from competition agencies and regulators would likely disappear if the regulator were general instead of being sector specific in nature).

There is also some friction among the various regulators in the US, and we surely need more coordination across national borders including with Europe. But the real danger is that powerful lobbies, working through members of Congress, are pushing back hard against the FSOC and its mandate.

Hefty fines imposed by US regulators for breaching the rules notably, the recent 8.9 billion settlement by BNP Paribas are already causing European banks to re think their compliance costs and the profitability of operating in the US. Regulators, recognizing the risks of allowing financial deglobalization to accelerate, have been seeking better means of handling the failure of huge global banks. The key to neutralizing the geopolitical advantage that Russia enjoys is to establish a unified energy policy with a Europe wide regulatory authority which has precedence over national regulators and a Europe wide distribution network. This would deprive Russia of its ability to play one country against another, because a concession granted to one national distributor would immediately become available to customers in all the other countries.

Their boom and bust character reflected nothing more than the relevant regulators failure or refusal to understand the risks involved. A European banking agency would break up the incestuous relationship between banks and regulators that was at the root of the excesses that fueled the current crisis. And it would interfere much less with national sovereignty than would the subordination of fiscal policies to an EU or eurozone wide authority.

Regulators could not go back and fix it with their new Dodd Frank powers, because the firm would already be ripped asunder. So, as it stands now, regulators need to preempt bankruptcy, not rely on it, because as soon as any failed financial firm files for bankruptcy, it has signed its own death warrant.

The largest, most sophisticated banks have become expert at remaining one step ahead of regulators constantly creating complex financial products and derivatives that skirt the letter of the rules. In these circumstances, more complicated regulations merely mean more billable hours for lawyers, more income for regulators switching sides, and more profits for derivatives traders.

That happened because European bank regulation is still characterized by a race to the bottom. Colleges of regulators, the supposed solution, are inadequate.

European banks remain balkanized, with a patchwork of national regulators seeking to promote their own champions. European governments debt may all be denominated in euro, but German and Italian debt are hardly the same thing, so the government euro bond market lacks the depth and liquidity of the US Treasury Bill market.

I confess that I am rather afraid of spiders, but even an arachnophobe like me found little reason to be worried. The FSF was not a scary creature, and the individual regulators, national and international, were largely left to their own devices, with all of the unhappy consequences with which we have become acquainted.

In practice, their implementation was, until recently, left to national regulators, who applied very different standards. Most important, while state subsidies in all other sectors are forbidden, they are commonly accepted in banking not only explicit subsidies, such as Germany s bailout of several Landesbanks after the American subprime mortgage crisis, but implicit subsidies as well.

There was also bureaucratic resistance from existing regulators. Most important, supervision suggested some potential responsibility to recapitalize problematic banks, and thus involved a fiscal cost.
