The Government replied that there are no persons in detention other than under valid judicial orders.

The source further states that the detention regime of persons in pretrial detention is decided by the investigating agency which, in the case of Mr. Marynich, is the KGB.

It is concerned that many persons have been in such administrative detention for over three years (art.

As at 23 June 2005, 58 persons were being detained at the Tribunal's detention facility, and 21 persons were on provisional release.

The Committee is also concerned that socio educative measures are not frequently applied and therefore, as a result, a large number of persons below age 18 are in detention, and at the very poor conditions of detention.

When in detention, a child must be treated humanely and in a manner which takes into account the needs of persons of his her age.

Criminal charges were filed against them for the existence of reasonable suspicion that the suspects committed following criminal offences trafficking in people to engage them in prostitution (53 persons), soliciting in prostitution (44 persons), establishment of slavery relations (4 persons), and illegal detention (5 persons). 42 foreign female citizens were charged with possession of forged passports.

These requests were later extended to include Iraq, Afghanistan and other detention centres where persons accused of terrorism were being held.

The mission also learned that 105 persons were in detention at the Bossaso prison, of which 50 had been sentenced and the remainder were awaiting trial.

Persons detained under suspicion of engaging in or planning terrorists acts and held in administrative detention must be brought before competent legal bodies promptly, generally within four days.

The Working Group conveys its appreciation to the Government for having submitted information reporting that the above mentioned three persons are no longer held in immigration detention.

The Special Rapporteur is concerned at ongoing allegations of the pervasive and systematic use of torture and ill treatment by the authorities against persons in pre trial detention.

The reason for his continued detention is that under Pakistani migration laws, an alien in detention in Pakistan cannot be released from detention unless and until he has been issued travel documents.

As the allegations of the source have not been disputed, the Working Group can only conclude that the detention of those persons does not have any legal basis.
