Also commends the Commission for the approval of the substance of the recommendations of the draft legislative guide on secured transactions, which has been designed to facilitate secured financing, thus promoting increased access to low cost credit and enhancing national and international trade

In conjunction with that session, an informal presentation was made of the recently completed secured transactions law in the Slovak Republic, which was supported by the World Bank and by EBRD.

Often weapons are diverted from poorly secured government stockpiles by corrupt officials or thieves, but frequently transactions are facilitated by illicit brokers taking advantage of poor or non existent import and export controls.

As regards the reporting obligation, the CTC has noted that no convictions have been secured in Thailand for failing to report suspicious transactions and that a maximum fine of 300,000 Baht may be imposed.

(j) Treatment of secured creditors

At its second session (Vienna, 17 20 December 2002), the Working Group considered chapters VI, VII and IX (A CN.9 WG.VI WP.2 and Add.6, 7 and 9) of the first preliminary draft guide on secured transactions, prepared by the Secretariat.

Assistance to law reform in the area of insolvency law reform includes the Regional Technical Assistance (RETA) 5975 Promoting Regional Cooperation in Insolvency Law Reforms addressing (a) informal workouts, (b) intersection between insolvency law and secured transactions law and (c) cross border insolvency.

The Working Group, which is preparing a draft legislative guide on secured transactions, has held until the thirty eighth session of the Commission, in 2005, seven one week sessions during which it considered draft chapters of the legislative guide prepared by the Secretariat.

In addition, the Commission emphasized the importance of coordination with organizations with interest and expertise in the field of secured transactions law, such as Unidroit, the Hague Conference on Private International Law, the World Bank, the International Monetary Fund, EBRD and the Asian Development Bank.

(b) Provide a temporal event for ordering priority among secured creditors and between a secured creditor and other classes of competing claimants.

As far as security interests were concerned, the Commission had noted the progress made by the Working Group in the preparation of a legislative guide designed to establish an efficient and modern legal regime for secured transactions, which would provide significant economic benefits for States adopting it.

His delegation also noted the work of the Working Group on Security Interests in preparing the draft legislative guide on secured transactions, and looked forward to future work of the Working Group on Insolvency Law, now that the UNCITRAL Legislative Guide on Insolvency Law had been concluded.

The Commission endorsed a suggestion made to revise the insolvency chapter of the draft legislative guide on secured transactions in light of the core principles agreed by Working Groups V and VI (see A CN.9 511, paras. 126 127 and A CN.9 512, para.

It may be that, as between the grantor and the secured creditor, the secured creditor has agreed to treat the proceeds as encumbered assets.

Reference was also made to the need to coordinate with the Hague Conference with respect to the conflict of laws chapter of the draft legislative guide on secured transactions, in particular with respect to the law applicable to the enforcement of security rights in the case of insolvency.

The idea of exempting banks secured debt from the pecking order for repayment is extremely problematic as well. While this proposal may sound harmless and almost self evident, it is not secured debt needs no further protection, because it is already secured.

The Commission also expressed its appreciation for the coordination with the World Bank, which was preparing principles and guidelines for effective insolvency and creditor rights systems, and in particular for the agreement that the World Bank text would form with the draft legislative guide on secured transactions a single international standard.
