E. Situation of the Constitutional Court and the Supreme Electoral Court

The absence of an independent Constitutional Court and Supreme Court was extremely worrying.

Almost a year later, the Constitutional Court and the Supreme Court had still not been appointed and Ecuador's international image was being damaged as a result.

The author observes that in his case the State party cited the text of a Supreme Court judgement in which it was expressly noted that both the Supreme Court and the Constitutional Court lacked competence to make a fresh appraisal of the facts and evidence.

All the courts, including the Supreme Court of Canada, are bound by the constitutional recognition in 1982 of existing aboriginal rights only.

The author's appeal to the Supreme Court was declared inadmissible on 26 September 1996, and an appeal to the Constitutional Court was dismissed on procedural grounds on 7 October 1998.

In its judgement, the Constitutional Court stated that it was not in its remit to review the weighing of the evidence done by the trial court, or to review the conclusions of the Supreme Court.

The first substantive issue addressed in the report (paras. 11 29) concerned his two missions to Ecuador, in April and July 2005, following the unconstitutional dismissal of the Constitutional Court, Supreme Electoral Court and Supreme Court and the subsequent ousting of the President of the Republic, Lucio Gutiérrez.

The majority of the Supreme Court of Canada found that an implied negative right not to associate existed but that the legislation was constitutional.

According to the judgement of the Constitutional Court, the Court decided that the alleged violation of lack of impartiality of the judges was inadmissible due to the author's failure to raise the issue before the Supreme Court.

This situation came about because all the members of the Constitutional Court were dismissed and it is legally impossible to set up a new Court until the Supreme Court, which is responsible for submitting a shortlist of candidates, is appointed.

The Special Rapporteur is concerned to note that, in the absence of a Supreme Court, which is responsible for proposing a shortlist of candidates, it is impossible to appoint the members of the Constitutional Court.

The author claims that all applications for amparo submitted to the Constitutional Court against the Criminal Division of the Supreme Court have been denied, and repeated rulings by the Constitutional Court have established that amparo does not constitute a third instance or permit reappraisal of the facts or review of sentences handed down by the ordinary courts.

While this appeal was still pending before the Supreme Court, the Constitutional Court handed down a judgement in which it decided that a judge who indicted an accused could not participate in the judgement against the same accused.

The number of female Justices on the Supreme Court has risen to 40 (six out of fifteen Supreme Court Judges).

The purpose of the visit was to follow up on his recommendations and, in particular, to help find the most appropriate means of resolving the crisis caused by the unconstitutional dismissal, on 25 November 2004, of the members of the Constitutional Court and the Supreme Electoral Court, followed by the dismissal of the members of the Supreme Court on 8 December.

With respect to the Constitutional Court, the Special Rapporteur observes that the National Congress has adopted a decision similar to the one taken regarding the Supreme Court, which was illegally dismissed in late 2004 it reversed the decision of 25 November 2004 whereby it had appointed a new Constitutional Court, but did not order the reinstatement of the members who had been removed under that decision.

The 2008 constitutional reform finally recognized this possibility. But a double filter of safeguards was established the jurisdiction before which the matter is brought, and the competent Supreme Court either the Council of State Conseil d État or the Final Court of Appeal which has three months to decide whether to refer a case to the Constitutional Council.

He was confirmed as a Justice of the Supreme Court with effect from 1 February 1991 and served in that office (presiding over criminal, civil, constitutional and family matters) until he was appointed to the Court of Appeal on 1 April 1997.
