19. Draft articles 3, 4 and 10 of the text were central to the issue.

The text of the draft articles provisionally adopted so far by the Commission is reproduced below.

191. The observer for the International Organization of Indigenous Resource Development expressed his support for articles 6, 7, 10 and 11 by reading the present text of those articles and suggesting that the present text should be kept unchanged.

4. Recommends that all efforts be made for the wide dissemination of the text of the articles

The representative of Mexico and the observers for the Syrian Arab Republic and Nigeria, while recognizing that the text of articles 1 and 8, as contained in annex II, constituted the basis for future work on these articles, stated that certain essential elements were still lacking from the text of these articles.

He suggested language for the articles by reading out the text as currently drafted.

As well, a comparative table outlining the concordance of the numbering between articles of the earlier draft and articles of the text below has been annexed to this note.

245. The observer for the International Organization of Indigenous Resource Development proposed language for articles 25 and 26 reading out the text of the articles as adopted by the Sub Commission.

311. The observer for the International Organization of Indigenous Resource Development suggested specific wording for articles 3, 31 and 34 by reading out the text of the articles in the draft.

Articles 11, 20, 21 and 23 of this text, which discriminated against women, were amended in turn in 1999.

Many of the draft articles incorporated from the 1991 text of the International Law Commission had remained unchanged, and therefore the Commission's commentary on those articles offered the basis for precise interpretation.

The text of articles relating to the presumption of innocence and the protection of the rights of the accused had been improved.

So far only two States had transmitted to the Secretariat their comments on the complete text of the draft articles.

9. The Chairman proposed that the informal consultation groups should consider the articles of the consolidated negotiating text as follows

The text of the articles remained substantially the same as that adopted in 2002, with the exception of some rearrangement between paragraphs.

The final numbering and placement of articles would be decided when the text of the entire draft optional protocol had been agreed.
