Many of the draft articles incorporated from the 1991 text of the International Law Commission had remained unchanged, and therefore the Commission's commentary on those articles offered the basis for precise interpretation.

The text of the draft articles together with commentaries thereto provisionally adopted by the Commission at its fifty seventh session is reproduced below.

Articles 6, 7 and 8 as contained in the first working paper, which formed the basis of the working paper considered at the third and fourth sessions, have been deleted or incorporated in the text of other articles.

The numbers and contents of articles correspond to those in the draft text proposed by the Chair in document A AC.265 2006 1.

The Working Group had considered articles II, III, IV and V of the text submitted by himself as Chairman and also the Costa Rican proposal.

Recalling its resolution 56 83 of 12 December 2001, the annex to which contains the text of the articles on responsibility of States for internationally wrongful acts,

Commends the articles on prevention of transboundary harm from hazardous activities, presented by the Commission, the text of which is annexed to the present resolution, to the attention of Governments, without prejudice to any future action, as recommended by the Commission regarding the articles

Recalling its resolution 56 83 of 12 December 2001, the annex to which contains the text of the articles on responsibility of States for internationally wrongful acts, and further recalling its resolution 59 35 of 2 December 2004 commending the articles to the attention of Governments,

The Working Group approved of the text for further discussion and for inclusion in the draft instrument, subject to the insertion of additional articles referring to notices and consents.

It had also examined a proposal submitted by the delegations of China, Japan, Jordan and New Zealand which addressed the articles of the Chairman's text that remained within brackets.

On the basis of negotiations, the Chairman of the Ad Hoc Committee had elaborated a draft text designed to bridge the differences expressed in relation to individual draft articles.

It was also suggested that any decision on the final form should be on the basis of a text integrating the draft articles on prevention and the draft principles.

The entire text of the first 16 articles of the Convention and of all the recommendations has been cast as specific questions or issues to which an attempt has been made to respond.

Taxpayers of imported articles refer to entry persons carrying the articles into China, the receiver of entering postal articles, and consignee of articles imported by other means.

Views varied as regards the need for the text of articles 5, 6 and 8 of the UNCITRAL Model Law on Electronic Commerce (A 51 17, annex I) to be quoted in paragraph 9.

Articles 4 and 5 of the text also reproduce the individual measures (ban on travel and freezing of assets), which were set forth under articles 9 and 11 of resolution 1572 (2004) and entered into force on 15 December 2004, as was confirmed by the presidential statement of 16 December 2004 (S PRST 2004 48).

While the Working Group proceeded in its work with the general understanding that nothing was agreed until everything was agreed , it decided to focus its discussions on those articles of the Chairman's text that remained in brackets, namely the third and fourth preambular paragraphs as well as articles II and III.

For the ease of the Working Group during its deliberations, the proposed text to provide for the conduct of electronic reverse auctions has been separated into two periods the pre auction period and the auction itself, presented as new articles 47 bis and ter respectively and with suggested Guide to Enactment text and additional commentary thereafter.

Other delegations noted that as, in the case of the work on prevention, the final version of the draft principles should take the form of draft articles, noting that such an approach laid the foundations for a binding legal text.

Kenya therefore supported the text of article III of the Chairman's revised text.

However, an attempt was made to produce a consolidated text , in which not only was the proposal by the OIC Group on article 18 omitted, but the articles of the draft convention were renumbered, besides certain technical changes being made.
