Accordingly, there exists no possibility of admitting as evidence any confession made under torture.

Finally, as noted by the representative of Costa Rica, under article 15 of the Convention against Torture the use of evidence that might have been obtained under torture ought to be unacceptable, and yet it did sometimes occur.

It is further reported that PTA allows confessions made under torture to be accepted as evidence against those arrested.

The prohibitions against torture and CIDT are non derogable under both ICCPR (article 7 concerning torture and CIDT and article 4 (2) on derogation during states of emergency), and CAT does not permit derogation from its provisions.

It remanded the case back to the immigration judge for consideration of Mr. Ali's eligibility for relief under the Convention against Torture.

The Committee against Torture (CAT) has stated the following concerning article 3 of the Torture Convention Whenever substantial grounds exist for believing that an individual would be in danger of being subjected to torture upon expulsion to another State, the State party is under an obligation not to return the person concerned to that State.
