Amendments to the Aruban Civil Code

Article 286 of the Civil Code provides that

A civil service code of conduct has been drafted.

In line with the Committee's general recommendations, Paraguay had amended its Civil Code, Labour Code, Electoral Code and Penal Code, which now defined sexual harassment and domestic violence as serious offences.

Ms. Maiolo noted that polygamy was permitted under the Civil Code.

The new Brazilian Civil Code entered into force in January 2003.

According to the Civil Code and the Code on Administrative Offences, legal entities might be subject to property and administrative liability.

There was no Family Code to decide such matters, but the Civil Code included laws covering children and adolescents, and in the absence of family courts the civil courts judges dealt with such issues.

They basically enshrined the second class status of women in the civil code.

Moreover, the Civil Code contained various provisions protecting the interests of the child.

The Act to amend the Civil Code and the Code of Civil Procedure as regards the determination of child support payments was enacted in 2004, with a view to more equal treatment for all children.

Under article 38 (c), any person who acquires Jordanian nationality may submit information to be recorded in the civil register.

In civil cases, the child victim may directly register an appeal of the verdict through his or her legal representative.

Registration of the marriage by the officer of the civil registry is required by Articles 214 ff of the Guinean Civil Code.

The Penal Code states that for those who organize weddings and register marriages for people under marriage age, imprisonment of two years may be imposed.

The Niger has a Civil Code inherited from the former colonial Power the Code of 1804. Although it is in force in the Niger, this Code is applied to a limited extent only.

The Judiciary Act and the Code of Civil Procedure was amended on 1 January 2002.

Article 216 of the Civil Code provides that A married woman has full legal capacity.

A new tax code was adopted, with lower and fewer taxes, notably a flat income tax of 13 . The civil code was completed, a new customs code was enacted, and substantial judicial reform was implemented.

Presently, the country's Constitution, the Criminal Code and the Civil and Commercial Codes are under review.

It is therefore necessary to align civil legislation with constitutional provisions by adopting a Family Code.

The above inequalities were abolished with the introduction of the new Civil Code in January 2002.

Article 32 (a) of the Act provides that all corrections of personal status entries listed in the vital statistics register or the civil status register are to be made pursuant to a decision of the competent court (the magistrate's court).

Under article 1 of the Family Code, only marriages registered with the civil registry office are recognized.

The Civil Code stipulates that all adult persons, whether male or female, have the same legal capacity.

The Governance Reform Commission has also produced a draft code of conduct for civil servants and public officials.

This capacity is protected by article 325 of the Civil Code A married woman has full legal capacity.

Second, policy with regard to Article 20, Book 2 of the Civil Code must be taken into account.

However, article 144 of the Civil Code sets the minimum age of marriage for women at 15 years.

It should be stressed that, under the Act, it is only errors in the civil status register (such as errors of name) that may be corrected.

(a) Knowingly gives incorrect information or submits forged documents or certificates in order to obtain a card or record an entry in the civil status register

To this end, the government has revised the Civil Code with respect to those articles that discriminate against women.

The legal capacity of women is also covered in the proposed amendments to the Civil Code dealing with equality.

Articles 49 to 53 prescribe the penalties to be imposed in the event that the provisions of the Act are contravened, as in the case of such acts as deliberate tampering with the civil register or the vital statistics register, or the submission of false information.

Parents' responsibilities with regard to guardianship, wardship, trusteeship and adoption of children are fairly shared in the revised Civil Code.

France had recently adopted amendments to its Civil Code regarding the notion of an original and that of a copy.

Permanent register

The Civil Code also provides that a civil transaction will be considered invalid if one contracting party use gender difference as an excuse to force women to sign contract or participate in civil transactions, or taking advantage of women's difficulties to force them enter into civil transactions.

On the women's rights to enter into contract the Civil Code continues to provide women's equal rights to enter into contract.

The Napoleonic Civil Code of 1804 was made applicable to the Niger immediately after independence, but has been applied only partially.
