Situation in the area and activities of the Force

Force majeure justifies non performance of the obligation for so long as the circumstance exists supervening impossibility justifies the termination of the treaty or its suspension in accordance with the conditions laid down in article 61.

While the same facts may amount, for example, to force majeure under article 23 and to a supervening impossibility of performance under article 61 of the Vienna Convention on the Law of Treaties, the two are distinct.

With the exception of force majeure, in cases where goods that are under the supervision of safekeeping by customs incur damages or losses, persons held liable for safekeeping of the goods under supervision shall be responsible for the corresponding liability of duty payment.

I believe that the present situation in Lebanon and the wider region does not support a change in the UNIFIL mandate or another reconfiguration of the Force at this stage.

The UNOCI forces, supported by the Licorne force, remain vigilant, especially in the zone of confidence, where the situation has become very tense following the incident in Logoualé on 28 February 2005.

It is therefore useful to find approaches for determining whether the combination of these measures is providing, at the aggregate level, timely improvement of the situation prevailing before the Convention entered into force.
