A person who (a) possesses a nuclear explosive device or (b) has control over a nuclear explosive device

s8(2) A person who acquires a nuclear explosive device is guilty of an offence against this subsection.

s8(1) A person who undertakes or engages in the manufacture or production of a nuclear explosive device is guilty of an offence.

s12. A person who undertakes or carries out a test of a nuclear explosive device is guilty of an offence against this section.

The fact that there has never been a major terrorist attack involving nuclear or other radioactive material should not blind us to the severity of the threat. There is evidence that terrorist groups have tried to acquire the material needed to construct a crude nuclear explosive device, or a dirty bomb.
