For the exercising of the right related to the pension and disability insurance, as well as determined needs and interests in the area of that insurance, two entity funds for pension and invalid insurance have been established.

Pension disability insurance (Note The Brčko District Government failed to adopt a law on pension disability insurance in the period 2000 2003, despite initiatives and numerous meetings with Entity governments representatives).

It is acquired by work, i.e. obligatory pension and disability insurance and voluntary insurance, as provided under the law.

Rights to pension and disability insurance are defined by law as follows

In order to carry out rights to pensions and disability insurance, two Entity funds for pension disability insurance were formed.

For women, the obligatory terms are 60 years of age and at least 20 years of pension insurance, while either men or women who do not have 20 years of pension insurance acquire the right to a pension with at least 25 years of pension seniority in the Federation of Bosnia and Herzegovina.

The right to disability pension is exercised by the insured party that was mandatory or voluntarily insured by pension and disability insurance

The pension system in Republika Srpska is governed by the Law on Pension and Disability Insurance (Official Gazette of Republika Srpska, 32 00).

In addition to the State Pension Insurance Act, the Funded Pensions Act has been in force since 2004, with the purpose of creating the opportunity for persons who have made contributions to a funded pension to receive additional income besides the state pension insurance after reaching retirement age.

A supplementary funded pension is a benefit for the receipt of which units of a voluntary pension fund are acquired or an insurance contract for a supplementary funded pension is entered into.

Rights to pension or disability insurance are acquired and exercised under conditions stipulated by law.

The right to disability insurance is acquired by an insured person who is obligatorily or voluntarily insured by pension or disability insurance and who

The agricultural workers and their families are covered under the Law on pension and disability insurance.

Funds for pension and disability insurance are provided for by the insured, employers and the State.

(c) It assigns a benefit of insurance of the goods in favour of the carrier or a person mentioned in Article 14bis.

The rights to work of the category II disabled are defined under regulations on pension and disabled persons' insurance.

Pension disability insurance is among the basic social welfare and basic social security rights, which are acquired based upon work.

They include obligatory pension or disability insurance and voluntary insurance for people in accordance with the laws, rights to old age pensions, disability pension due to reduction or loss of work ability and the death of the insured, and the provision of social security to insured persons and their family members.

Also, the employer is obligated to maintain allotment of his ratio in the pension fund or directors insurance during maternity leave.

The extent of rights depends on the length of pension seniority and salary levels that the insured had during his work period, or the base amounts paid as contributions for pension and disability insurance.

Amendment no. 24 anchors the employer's duty to continue allotment of employees' pension, pension fund or directors insurance and savings plan during a pregnancy observation period, provided the employee maintains allotment of her share.

Female workers who have paid social insurance for 15 years receive pension equal to 45 of the average monthly salary, which is the basis for payment of social insurance, as applied for male workers.

Rights to pension and disability insurance are inalienable personal material rights and they cannot be transferred to or inherited by other persons.

Out of a total of 165,481 pensioners to whom pensions are provided in Republika Srpska, as at December 2001, there were 32,510 persons receiving disability pension with an average pension of KM 117.75 (Report on the status of pension and disability insurance and recommendations, April 2002).

In case a man or a woman does not have 20 years of service as far as insurance goes, they earn their right for a pension when they fulfill at least 25 years of pension service.

Mothers affiliated to the IKA TEAM (Social Insurance Fund Employee's Supplementary Insurance Fund, the largest Insurance Fund in Greece) who give birth after 1 1 2003 or, if the right is not exercised by mothers, then fathers, can have a fictitious insurance period recognized, in order to fulfill the conditions for a minimum insurance period and be entitled to pension rights.

In accordance with the law, the resources of the pension and invalid insurance are provided by the insured parties, employers, and the state.

Female workers aged 55, having paid social insurance for 25 years and male workers aged 60, having paid social insurance for 30 years, are entitled to equal maximum monthly pension in accordance with the Government's regulations.

The rights to a pension and disability insurance are provided for in accordance with the law for insured persons by employers and the State.

During its 2003 session, the Standing Committee reviewed a note on the after service health insurance premium deduction programme undertaken by the Pension Fund.

Every party that is insured by pension or disability insurance gains the right to disability pension if the disability is caused by an injury outside of work or by disease under the condition that they have fulfilled a pension service that would cover at least one third of their work service.

For men affiliated to Special Funds the age for pension entitlement was reduced by two years and therefore harmonized with the age for pension entitlement for women, so that, the people insured to those Funds (irrespective of sex) who became affiliated to any main insurance Fund from 1 1 1983 to 31 12 1992 may be entitled to old age pension when they reach their 58th year of age or 35 years of insurance.

Has this name been circulated to non banking financial institutions, i.e., pension, insurance and financial leasing companies, foreign exchange bureaus, securities firms and credit unions?

31.1 Under section 31, Special expenses, resources are provided to cover specific expenditure requirements for (a) after service health insurance (b) compensatory payments (c) general insurance charges (d) bank charges and (e) pension payments to former Secretaries General (see table 31.1).

The parties that are insured by voluntary insurance based on their agricultural activities gain the right to a disability pension if their disability is caused by a work injury or a profession related illness, regardless of the length of their pension service.

Each person with disability insurance has the right to a pension if the disability was caused by a work related injury or illness, under the condition that he she had pension seniority that covers at least one third of his her working time.

To this should be added the problem of workers entitled to retirement but who cannot use this right because the employers have not paid for pension insurance.

The extent of this right depends, as a rule, on the length of the pension service and the salary that the insured party earned during their work span, that is, on the principle onto which the contribution for pension and disability insurance was paid.
