It should be recalled that, until the dissolution of the Union of Soviet Socialist Republics (USSR), the legal status of the Caspian Sea was governed by the Treaty entered into with Persia in 1921 and the 1940 Commerce and Navigation Treaty between the USSR and the Islamic Republic of Iran.

In that regard, the Treaty of Amsterdam contained a general clause on non discrimination which allows the Council of the European Union, following the ratification of the Treaty, and at the proposal of the European Commission, to take appropriate measures to combat any discrimination based on gender, race, ethnic origin.

The Union pledges its continuing support for the further promotion and protection of human rights, in fulfilment of the Treaty on European Union, the European Convention for the Protection of Human Rights and Fundamental Freedoms and the European Council Declarations of Luxembourg 1991 and 1997, and adopts the following Declaration

The second unresolved question is how to achieve a banking union in legal terms. Constitutional change on this scale would normally require a new European treaty.
