Access to asylum procedures was occasionally problematic during the reporting period.

The Committee recommends that the State party ensure the effective implementation of the new Asylum Law and that refugee and asylum seeking children have access to basic services such as education and health, and that there is no discrimination in benefit entitlements for asylum seeking families that could negatively affect children.

UNHCR is working in this challenging context to preserve access to asylum for those who seek it based on a well founded fear of persecution.

The refugee protection environment in Africa continued to be generally positive, with most new arrivals gaining access to asylum, for example in Togo and Uganda, and Governments respecting overall the rights of refugees.

There is also a need to ensure that those seeking asylum have access to the Office of the United Nations High Commissioner for Refugees (UNHCR) and to procedures for determining their status if they fall into the category of refugees, they should be allowed to stay in the asylum country, at least temporarily, and should be treated humanely.

If the first asylum country is not able or willing to grant refuge to the asylum seekers, other countries should offer resettlement places.

There is clearly a need for States to address asylum abuse and people smuggling, but, in this process, asylum must be preserved.

In exchange, these countries should be helped financially and provided with other incentives for example, easier access to the EU for their citizens. Indeed, the EU should establish or expand programs that allow entry to non asylum seekers.

The 1951 Convention is undermined where people seeking international protection are unable to gain access to territory.
