7.7 In relation to the alleged violation of the right to be free from arbitrary arrest and detention, it is uncontested that the author was arrested without a warrant.

Arbitrary arrest, detention and torture were all too common, for example, in Turkmenistan, and in Nepal, the Government's response to the ongoing insurgency had resulted in alarming human rights violations.

Arbitrary arrest and detention cases reported during the period under review numbered more than 860, the majority in Bujumbura rural, Cibitoke and Bubanza provinces, but also in Makamba, Bururi and Rutana provinces.

6.1 The first issue before the Committee is whether the author's arrest on 16 October 1999 and his subsequent detention until 25 November 1999 were arbitrary or otherwise in violation of article 9 of the Covenant.

The Committee concludes that in the circumstances, the author's arrest and detention were neither reasonable nor necessary but, at least in part, of a punitive character and thus arbitrary, in violation of article 9, paragraph 1.
