If a person suspected in committing such an act appears to be on the territory of the Republic of Armenia, a criminal persecution will be initiated in the order prescribed by the RA Criminal Procedural Code.

The previous Criminal Code defines homosexuality as a criminal offence, while the new Criminal Code eliminates such a stipulation.

Chapter 54 of the RA Criminal Procedural Code regulates the order and conditions of conducting a criminal prosecution undertaken upon requests from competent authorities of those states, with whom Armenia does not have an agreement on legal assistance in criminal cases within the scope of international agreements.

According to Part 2 of Article 197 of the RA Criminal Procedural Code the preliminary investigation of a criminal case is to be completed in a term of not more than two months, starting from the day of the decision on the initiation of the criminal case.

Chapter 12 of the RA Criminal Procedural Code regulates the issues concerning the protection measures of victims, witnesses, accused persons, their legal representatives, lawyers and other persons participating in the criminal proceedings (of prosecutor, investigator, the representative of the investigation authority).

In Indonesia, free legal counsel was made available to poor suspects, especially suspects under threat of jail sentences of 15 years or above (based on Criminal Procedural Code No. 8 of 1981).

According to Article 232 of the RA Criminal Procedural Code the arrest (freezing) of financial funds (or any other property) is carried out in order to ensure the civil suit on the criminal case, possible confiscation of the assets and the judicial expenses.

(g) Harmonization unification of the criminal code and the penal code

Arrest (freezing) of financial funds (and other property) is carried out on the basis of the decision of investigative body, the investigator or prosecutor (Part 2 of Article 233 of the RA Criminal Procedural Code).

The package includes a transitional criminal code, a transitional code of criminal procedure, a transitional detention act and a model transitional police directive.

Criminal liability of legal persons will be provided for in the recodified Criminal Code.

Chapter 2 of the Criminal Code sets out the general principles of criminal responsibility.

Under section 6A of the Crimes (Biological Weapons) Act, Chapter 2 of the Criminal Code Act 1995 (the Criminal Code) applies in relation to these offences.

Positive aspects The Committee notes with satisfaction the enactment of new legislation containing anti discrimination provisions, including the Criminal Code and the Code of Criminal Procedure.

It notes that the procedural and substantive requirements for the interception of telephone calls are clearly defined in section 125g of the Dutch Code of Criminal Procedure and in the Guidelines for the Examination of Telephone Conversations of 2 July 1984.

By Article 14 of the Criminal Code the person who committed a crime, is subject to criminal liability in accordance with the Code, irrespective of his status.

There were no breaches of criminal or procedural law that would lead to an overturn of the conviction.

The norms of Chapter 54 of the RA Criminal Procedural Code regulate the procedures for undertaking legal activities by the Armenian competent authorities acting upon the requests from foreign governments, and transferring the results to the requesting country, in accordance with RA International Agreements.

The Code of Criminal Procedure provides for special regulation for collecting evidence.

We are assessing all possible implications for our domestic criminal code system.

The penal code and the code of criminal procedure include provisions specifically for the administration of justice with respect to minors.

Legal provisions addressing cybercrime should ensure that the criminal code is capable of being applied to acts involving the use of computers, rather than involve a wholesale revision of the existing criminal code.

With respect to offences relating to trafficking in children, child prostitution and child pornography, section 3 of the Criminal Code applies. This section deals with joint crimes and the determination of criminal responsibility of offenders (see articles 25 29 of the Criminal Code).

The Law on the Fight Against Legalizing the Illegal Income and Financing of Terrorism, as well as RA Criminal Procedural Code (Articles 232 234) provide the possibility for arresting (freezing) effectively those financial funds, which belong to persons linked to terrorist activity, regardless of their origin.

Under article 167 of the Criminal Code, trafficking in minors is criminally punishable.

The application of the 2004 interim criminal procedure code has been particularly problematic.

In addition, the Criminal Code had been revised, providing severer punishments for rape.

On 1 July 2004, the new Code of Criminal Procedure entered into effect.

Federation officials also pressed the police to bring criminal proceedings against the complainant under article 295c of the Pakistani Criminal Code.

Consequently, the plan is to add to the Criminal Code a new article establishing natural persons' criminal liability for financing terrorist activity.

According to provisions of Chapter 54 (Articles 474 476 and others), an investigation undertaken upon requests from foreign states in RA territory is conducting by RA competent authorities in a way prescribed by the RA Criminal Procedural Code, taking into account the exceptions provided for by RA International Agreements.

The procedural code, order 5 96, issued in 1996, for example, outlaws any criticism of the Convention and provides for imprisonment of up to 20 years and the outlawing of related organizations for those who violate this code.
