The Criminal Code Amendment (Trafficking in Persons Offences) Act 2005 came into effect on 3 August 2005.

The Committee welcomes the amendment of 2 November 2004 of the Criminal Code rescinding article 223 1, which stipulated criminal penalties for unregistered activities of public associations, including non governmental organizations.

The Criminal Law (Amendment) Act amends Sections 299, 302, 305, 308, 310, 311, 316, 324, 337, 338 of the Pakistan Penal Code (PPC) and Sections 345, 401 of the Code of Criminal Procedure (CrPC) to ensure more effective prosecution of cases of the so called honour killings.

The Criminal Law (Amendment) Act amends Sections 299, 302, 305, 308, 310, 311, 316, 324, 337, 338 of the Pakistan Penal Code (PPC) and Sections 345, 401 of the Code of Criminal Procedure (CrPC) to ensure more effective prosecution of cases of the so called honour killings.

Criminal Procedure Code

The previous Criminal Code defines homosexuality as a criminal offence, while the new Criminal Code eliminates such a stipulation.

Moreover, under the 2004 amendment to the Criminal Code effective from 1 August 2004, illegal arming and trafficking in arms was established as a new type of criminal offence its wording is attached as annex to this Report.

(g) Harmonization unification of the criminal code and the penal code

The package includes a transitional criminal code, a transitional code of criminal procedure, a transitional detention act and a model transitional police directive.

The Criminal Law (Amendment) Act, 2004 is aimed at combating such instances.

Criminal liability of legal persons will be provided for in the recodified Criminal Code.

Chapter 2 of the Criminal Code sets out the general principles of criminal responsibility.

Under section 6A of the Crimes (Biological Weapons) Act, Chapter 2 of the Criminal Code Act 1995 (the Criminal Code) applies in relation to these offences.

Positive aspects The Committee notes with satisfaction the enactment of new legislation containing anti discrimination provisions, including the Criminal Code and the Code of Criminal Procedure.

By Article 14 of the Criminal Code the person who committed a crime, is subject to criminal liability in accordance with the Code, irrespective of his status.

The Criminal Code has provisions for punishing violence against women.

(f) The alleged reluctance of prosecutors to institute criminal proceedings under article 137A of the Criminal Code.

Specially, the Criminal Procedure Code was adopted with provisions to ensure better human rights protection in criminal proceeding.

Those provisions have been incorporated into the Code of Criminal Procedure.

The Criminal Code prohibited rape, and marital rape was considered rape.

Armenia stated that its Criminal Code (chap. 7, in particular art. 41, of the Code) covered all serious crimes involving organized criminal groups provided for article 5, paragraph 1 (a) (i).

Until the recent amendment of the Labour Code, all types of informal employment, including part time work and fixed time work, had been excluded from the scope of the Code.

The Code of Criminal Procedure provides for special regulation for collecting evidence.

We are assessing all possible implications for our domestic criminal code system.

The penal code and the code of criminal procedure include provisions specifically for the administration of justice with respect to minors.

Legal provisions addressing cybercrime should ensure that the criminal code is capable of being applied to acts involving the use of computers, rather than involve a wholesale revision of the existing criminal code.

With respect to offences relating to trafficking in children, child prostitution and child pornography, section 3 of the Criminal Code applies. This section deals with joint crimes and the determination of criminal responsibility of offenders (see articles 25 29 of the Criminal Code).

By a 1999 amendment, some provisions of the Code discriminatory to women were abrogated, namely, articles 11, 20, 21 and 29.

Under article 143 of the Criminal Code, Violation of equal rights of citizens

Under article 167 of the Criminal Code, trafficking in minors is criminally punishable.

The application of the 2004 interim criminal procedure code has been particularly problematic.

In addition, the Criminal Code had been revised, providing severer punishments for rape.

On 1 July 2004, the new Code of Criminal Procedure entered into effect.

Federation officials also pressed the police to bring criminal proceedings against the complainant under article 295c of the Pakistani Criminal Code.

Another important revision is Amendment no. 36 (2002) of the Criminal Procedure Ordinance, adding sections 59A and 62A.

Act No. 17,292 (Second Emergency Act), article 64, is an amendment to the Penal Code which deals with violation of health regulations.

Consequently, the plan is to add to the Criminal Code a new article establishing natural persons' criminal liability for financing terrorist activity.

(g) To remove the remaining restrictions on the activities of public associations, including non governmental organizations, and to enable those organizations, in particular human rights organizations, and other civil society actors to carry out their activities without hindrance, building upon the amendment of 2 November 2004 to the Criminal Code of Turkmenistan abolishing criminal penalties for unregistered activities of public associations

Urgently revising the country's Criminal Code and the Civil Code with a view to reinforcing protection and physical integrity of women, and promoting her development

Individual provisions of the Criminal Code apply to men who use violence against their wives.

It matters to mention that the process of reform of the Criminal Code is underway.
