(b) The amendments to the Family Act, the Criminal Code and the Criminal Procedure Act in 2003

Under section 6A of the Crimes (Biological Weapons) Act, Chapter 2 of the Criminal Code Act 1995 (the Criminal Code) applies in relation to these offences.

The package includes a transitional criminal code, a transitional code of criminal procedure, a transitional detention act and a model transitional police directive.

Entries 2 and 57 replace Act No. 88 by article 91 of the Criminal Code .

Chapter 2 (other than Part 2.5) of the Criminal Code applies to all offences against this Act.

It is important that an illegal act committed by a person is prescribed by the Criminal Code.

The Criminal Code Amendment (Trafficking in Persons Offences) Act 2005 came into effect on 3 August 2005.

By the provision of Paragraph 4 of Article 38 of the RA Criminal Code, the recruitment act itself would be considered as an act of incitement to carry out a terrorist or other criminal act, as the aim of recruitment is the involvement of persons in the commission of a criminal act.

Changes had also been made to the Code of Criminal Procedure and the Hindu Succession Act to empower women further.

Suppression of the financing of terrorism Criminalization of this act is included under the provision on the preparation of the criminal offence in the amended Criminal Code (Art.

The previous Criminal Code defines homosexuality as a criminal offence, while the new Criminal Code eliminates such a stipulation.

As acts prescribed by the Criminal Code are prohibited in principle, no organization can be established (be registered by the state) in Armenia if at least one of its purposes is committing an act, which is prescribed by the Criminal Code.

According to the new Article on Financing of Terrorism (Article 217) amended into to the Criminal Code, any person who finances an execution of terrorist act is subject to criminal liability.

(g) Harmonization unification of the criminal code and the penal code

Pursuant to this Act, a draft law was prepared on amending and supplementing the Code of Criminal Procedure of the Republic of Belarus concerning the provision of international legal assistance in criminal matters .

The Criminal Law (Amendment) Act amends Sections 299, 302, 305, 308, 310, 311, 316, 324, 337, 338 of the Pakistan Penal Code (PPC) and Sections 345, 401 of the Code of Criminal Procedure (CrPC) to ensure more effective prosecution of cases of the so called honour killings.

The Criminal Law (Amendment) Act amends Sections 299, 302, 305, 308, 310, 311, 316, 324, 337, 338 of the Pakistan Penal Code (PPC) and Sections 345, 401 of the Code of Criminal Procedure (CrPC) to ensure more effective prosecution of cases of the so called honour killings.

Moreover these persons are subject to criminal liability in accordance with the RA Criminal Code for commission of such offences outside Armenia which are prescribed by Article 388 of the RA Criminal Code (terrorist act against representatives of foreign state or international organization), Article 389 (international terrorism) and by several other articles, regardless of the fact whether the mentioned acts are prescribed by the criminal code of the state where there were committed.

(4) The act that is the grounds for the extradition request is not an offence in accordance with the Criminal Code of the Republic of Belarus

Article 2 of the Convention, relating to terrorism and the criminalization of terrorist financing, matches articles 86 and 86 bis of Act No. 97 of 1992, amending the Penal Code and the Code of Criminal Procedure and concerning account secrecy and weapons and ammunition (known as the Terrorism Act ).

For the mentioned crimes in the Penal Code and for terrorist crimes according to the Act on Criminal Responsibility for Terrorist Crimes, Swedish courts have universal jurisdiction.

If a person suspected in committing such an act appears to be on the territory of the Republic of Armenia, a criminal persecution will be initiated in the order prescribed by the RA Criminal Procedural Code.

The Criminal Code has provisions for punishing violence against women.

(f) The alleged reluctance of prosecutors to institute criminal proceedings under article 137A of the Criminal Code.

The Criminal Code will specify the liability of natural persons for financing terrorist activity, while the Act on counter terrorism will lay down the liability of legal persons for financing terrorist activity.

The Penal Code of Burkina Faso accordingly criminalized the existence of an organized criminal group as a separate offence, before the commission of any act that was the subject of the agreement.

The Armenian Criminal Code clearly refers to terrorist acts in Article 217 Terrorist acts , Article 388 Terrorist act against a representative of a foreign state or international organization, Article 389 International terrorism .

The adoption of the Anti Terrorism Act was accompanied by the introduction of changes to the Security Service Act, the Police Investigations Act and the State Border Service Act, as well as the Code of Criminal Procedure, which enhance the effectiveness of anti terrorist activity while guaranteeing respect for civil rights in the context of such activity.

Specially, the Criminal Procedure Code was adopted with provisions to ensure better human rights protection in criminal proceeding.
