XII. Non derogation

The derogation clause cannot, in these conditions be applied.

Article 88a is the derogation provision.

In cases of derogation the Committee considers whether the State party has satisfied the conditions of article 4 of the Covenant and, in particular, insists that the derogation be terminated as soon as possible.

While a view was expressed that no derogation from the provisions of the draft instrument should be allowed under any conditions, there was support for derogation to be allowed in some circumstances.

Derogation clauses are set forth in article 27 of the American Convention, article 15 of the European Convention and article 4 of ICCPR. Derogation should be explicit so that the intention to derogate was clearly demonstrated.
