5.4 In any event, the enforcement of the deportation order despite the pertinent arguments raised in the proceedings before the Bordeaux Administrative Court of Appeal rendered the appeal ineffective.

In his cassation appeal against this judgement, the author contended that his defence relating to the tapped telephone calls had till not been responded to.

The lawyer appealed against this decision, but this appeal was not heard, since the motion challenging the report had been denied on procedural grounds.
