32. In Namibia, the Ministry of Trade and Industry was carrying out a comprehensive review of the existing legislation in the field of Commercial and Company Law, Law of Property, Law of Contract, Intellectual and Industrial Property Law and the impact of the Labour Act and the judicial system on competition in Namibia.

The Committee is concerned that the Industrial Relations Act unduly restricts the right to strike by providing for a compulsory arbitration procedure in industrial labour disputes.

The Act on the Expropriation of Immovable Property and Special Rights (603 1977) provides that a property owner is entitled to full compensation for the financial losses caused by the expropriation (section 29 of the Act).

It has also participated actively in the negotiation of various free trade treaties that include an industrial property section.

This, however, excludes proceedings in which the Industrial Relations Court under the Industrial and Labour Relations Act, chapter 269 of the Laws of Zambia, has exclusive jurisdiction.

85. Sections 3 and 4 of the Industrial Disputes Act carry provisions for conciliation and arbitration procedures.

Examples of topics in the former category include ownership requirements, industrial and intellectual property agreements, performance requirements and operational permits and licenses.

133. A strike is not illegal in Sri Lanka unless it is in violation of the Public Security Ordinance, the Industrial Disputes Act or the Essential Public Services Act.

Parliament had recently passed the Property (Right of spouses) Act, soon to enter into effect, which allowed for the equitable division of property between spouses on the breakdown of marriage.

Persons whose property had been confiscated were, under section 23.2 of the Act, eligible to recover their property, subject to conditions to be spelled out in a separate restitution law.

86. Part III of the Industrial Disputes Act provides the legal basis for another source of wage determination collective agreements.

A number are family owned enterprises, including Pacific International Lines (shipping), Hong Leong Asia (industrial) and City Developments Ltd. (property development and hotels).
