In order that the obligation to exchange information may be broad, a domestic tax interest requirement should not limit the obligation to exchange information.

II. Scope of the obligation

As with article 23, article 24 is a positive obligation on the State party requiring it to act to take measures concerning the protection of children, and a breach thereof is not necessarily established by information directed at establishing a breach of the negative obligation in article 17 to refrain from action.

Alternatively, the obligation under draft article 47 bis of the Model Law could be to provide all relevant information to the extent that the solicitation documents have not already done so.

The difference between variant A and B is here that according to variant A the strict liability comprises the obligation to provide this information, as well as its accuracy and completeness.

Reporting was an obligation, not a choice.
