The current government has abolished the compulsory invalidity insurance for the self employed along with the associated benefits fund and the entitlement to the aforementioned benefits for the self employed.

As from July 2004, as a result of the abolition of the Invalidity Insurance (Self employed Persons) Act, the self employed are no longer entitled to benefit in the event of adoption.

The Special Rapporteur clearly preferred the words validity invalidity , which were entirely neutral, to the other terms proposed, such as admissibility inadmissibility , permissibility impermissibility or opposability non opposability , which had strong doctrinal connotations.

The Commission should therefore revert to the neutral terms validity invalidity , including in the draft guidelines that had already been adopted (1.6 and 2.1.8), in which the words permissible impermissible had been left in square brackets.
