A legal framework could also contain a combination of legally binding and non binding elements.

Forests affect, and are directly and indirectly affected by, a considerable number of binding and non binding instruments, each having a particular focus and mandate that determines its scope in respect of forests.

It also supported the negotiation of a universal and legally binding instrument that provided security guarantees of non use of nuclear weapons against non nuclear weapon States.

(i) A non legally binding instrument such as an enriched and stronger version of the current international arrangement on forests

The Declaration voted upon today is non binding and does not reflect agreement among the wider membership of the General Assembly.

In addition, Brazil has always maintained that a political declaration, as a non binding instrument, should be reached only by consensus.

The Working Group had the role of determining standards of a legislative kind along with non legally binding kinds of guidelines.

If legally binding security assurances were given by the five nuclear weapon States to non nuclear weapon States, it would avoid unnecessary insecurity.

It was equally important to continue the development of a universal and legally binding instrument on security assurances to non nuclear weapon States.

Legally binding security assurances by the nuclear weapon States to the non nuclear weapon States parties to the NPT would significantly strengthen the nuclear non proliferation regime by eliminating incentives for pursuing capabilities.

(d) Diplomatic assurances are not legally binding. It is therefore unclear why States that violate binding obligations under treaty and customary international law should comply with non binding assurances. Another important question in this regard is whether the authority providing such diplomatic assurances has the power to enforce them vis à vis its own security forces

Pakistan, for its part, declared that only unconditional guarantees having binding force can effectively meet the security concerns of the non nuclear weapon States.

International cooperation in this area can take place either on an informal basis, or in pursuit of the application of an international instrument (the term instrument is used here to cover both legally binding treaties or agreements and non binding recommendations or undertakings).

(d) The formalizing of existing informal bilateral arrangements regarding non strategic nuclear reductions, such as the Bush Gorbachev declarations of 1991, into legally binding agreements

The aim would be to reinforce or promote cooperation under bilateral or regional agreements, rather than to replace such cooperation, since enforcement cooperation under non binding OECD instruments tends to be less intensive and case oriented if not backed up by a binding bilateral agreement.

Early conclusion of a universal, unconditional and legally binding instrument on security assurances to non nuclear weapon States should be given attention at the Review Conference.
